Abstract

Masih banyaknya terjadi pelanggaran terhadap hak pekerja atau buruh yang seharusnya mereka terima dalam situasi sebuah perusahaan melakukan penggabungan atau merger dimana terjadi ketidakpastian hukum dalam melindungi para pekerja atau buruh dari perusahaan yang melakukan merger atau penggabungan yang melanggar Undang-undang 1945. Tujuan penelitian ini adalah untuk untuk melakukan penelitian mengenai hak – hak pekerja atau buruh yang mengalami Pemutusan Hubungan Kerja Sepihak oleh perusahaan yang melakukan Merger. Metode yang digunakan dalam penelitian ini adalah metode hukum normatif dengan teknik pengumpulan data sekunder melalui studi kepustakaan. Hasil penelitian ini menunjukkan bahwa pelaksanaan penggabungan perusahaan (merger) memberikan dampak hukum bagi karyawan, salah satu dampak yang dapat diterima oleh karyawan adalah hilangnya pekerjaan Sebagaimana yang telah diatur dalam peraturan Undang undang baik dalam Undang-undang Perseroan Terbatas maupun dalam Undang-undang Ketenagakerjaan yang memberikan perlindungan hukum bagi karyawan. Apabila pihak perusahaan tidak mau bertanggung jawab maka karyawan dapat menuntut pihak perusahaan baik melalui jalur litigasi maupun non litigasi. Kata Kunci : Tanggung Jawab, Perusahaan, Pekerja, PHK, Merger. ABSTRACT There are still many violations of workers' or laborers' rights that they should receive in situations where a company is merging or merging where there is legal uncertainty in protecting workers or laborers from companies that are merging or merging in violation of the 1945 Law. The aim of this research is to conduct research regarding the rights of workers or laborers who experience unilateral termination of employment by companies carrying out a merger. The method used in this research is a normative legal method with secondary data collection techniques through literature study. The results of this research show that the implementation of a company merger (merger) has a legal impact on employees, one of the impacts that can be received by employees is the loss of their job. As regulated in legal regulations both in the Limited Liability Company Law and in the Employment Law which provides legal protection for employees. .
