Abstract

ABSTRACT This research is entitled GOVERNMENT AUTHORITY IN LEGAL PROTECTION FOR COMMUNITY RIGHTS RELATED TO THE REDISTRIBUTION OF ABANDONED LAND BASED ON LAW NUMBER 5 OF 1960. Land redistribution in UUPA No. 5 of 1960 is a policy that aims to improve the socio-economic conditions of the people by distributing land fairly and equitably to residents. In the context of agrarian reform, land redistribution is also one of the steps taken by the government to reduce the gap in land ownership and tenure. The research method used in this thesis uses the Normative legal research method which is literature research, namely research on laws and regulations and literature or reading materials related to the material discussed. The problem of inequality in land ownership is often encountered by the Indonesian people. The peasants did not own agricultural land, while the upper economic class owned many plots of land. So this is contrary to the purpose of the UUPA. For this reason, a land redistribution program was held, Land controlled directly by the state was distributed to sharecroppers through a land redistribution program, with the hope of improving the standard of living of farmers. Thus, community rights must be guaranteed through a transparent, participatory, and fair process to reduce potential disputes related to land ownership. Keywords : Legal protection, Redistribution, Wasteland, Land Rights ABSTRAK Penelitian ini berjudul KEWENANGAN PEMERINTAHAN DALAM PERLINDUNGAN HUKUM BAGI HAK MASYARAKAT TERKAIT REDISTRIBUSI TANAH TERLANTAR BERDASARKAN UNDANG�UNDANG NOMOR 5 TAHUN 1960. Redistribusi tanah di dalam UUPA No 5 Tahun 1960 merupakan kebijakan yang bertujuan untuk memperbaiki kondisi sosial-ekonomi rakyat dengan membagikan lahan secara adil dan merata kepada warga. Dalam konteks reforma agraria, redistribusi tanah juga menjadi salah satu langkah yang diambil pemerintah untuk mengurangi kesenjangan pemilikan dan penguasaan tanah. Metode Penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian hukum Normatif yang merupakan penelitian kepustakaan, yaitu penelitian terhadap peraturan Perundang-undangan dan literatur atau bahan bacaan yang berkaitan dengan materi yang dibahas. Masalah ketimpangan pemilikan tanah sering kali dijumpai bangsa Indonesia. Para petani tidak memiliki lahan pertanian, sedangkan golongan ekonomi atas memiliki banyak bidang-bidang tanah. Sehingga hal tersebut bertentangan dengan tujuan UUPA. Untuk itu maka diadakan program redistribusi tanah, Tanah-tanah yang dikuasai secara langsung oleh negara dibagikan kepada petani penggarap melalui program redistribusi tanah, dengan harapan untuk dapat meningkatkan taraf hidup para petani. Dengan demikian, hak-hak warga sekitar harus dijamin melalui proses yang transparan, partisipatif, dan adil untuk mengurangi potensi sengketa terkait kepemilikan tanah.
