Abstract
Research The online marketing industry is growing rapidly, especially through platforms such as TikTokShop that provide a platform for affiliate marketers (affiliators) to market certain products. However, this development also raises various legal challenges, especially when misleading advertising practices occur, as seen in the promotion of collagen drinks. This research aims to investigate the liability of affiliators, TikTokShop marketplace, and manufacturers for misleading advertising practices related to collagen drinks in the online marketing world. This research uses a normative juridical approach by analyzing relevant laws and regulations, including the Consumer Protection Law, Advertising Regulations, and other regulations related to online marketing. In addition, this research also involves case analysis and literature review to provide a thorough understanding of the issues raised. Manufacturers, on the other hand, have the responsibility of ensuring the truth and safety of the products they market. Manufacturers must provide accurate and clear information related to product content and benefits, especially in collagen drink products that are often associated with certain health claims. This study concludes that the practice of misleading advertising in online marketing through TikTokShop, specifically related to collagen drinks, involves the liability of affiliators, TikTokShop marketplace, and manufacturers. The role of each party in the marketing chain plays an important role in ensuring the truthfulness, accuracy, and safety of the information conveyed to consumers. By identifying and analyzing these liabilities, this research contributes to developing a stronger legal basis to address the challenges of misleading advertising practices in the online marketing world.
