Abstract

ABSTRACT The research entitled “Legal Certainty and Recognition of Customary Land Rights Related To One Sided Claim Potential by Government” is intended firstly to know and analyze the characteristics of the legal institution that customary people owned that is related to the recognition of customary land that’s been managed by customary people around the area of customary land. Second is to know and analyze the implication of customary forest regulation and also authorization by the nation related to rights protection on customary people. The research method used in this paper is none other than Normative Research which means this research is researching based on the legislation side itself, or in other words this research is not based on the social symptom that caused by existing legislation. The social symptom that the existence is felt in this paper is not necessarily happen or in other words is only feared to happen because the lack of ease on accessing the legislation by the customary people, who are got used to guided by customary law, not the nation’s law. Based on the result and the discussion of this research, can be concluded that the legal institutions about recognition of customary land rights that all this time has been managed by customary people is existed and comprehensive, although there are still lots of room that could be used by the government to try to taking over the customary land and also customary forest that all this time has been managed by the customary people one sidedly, the fact is that the recognition of the existence of customary land also customary forest are real and the government should have realized that. Keywords: recognition of land rights, customary land, customary forest, customary people, government, legal institutions. ========================================================== ABSTRAK Penelitian yang berjudul “KEPASTIAN HUKUM SERTA PENGAKUAN HAK ATAS TANAH ADAT TERKAIT POTENSI KLAIM SEPIHAK OLEH PEMERINTAH” bertujuan yang pertama untuk mengetahui dan menganalisa karakteristik Pranata Hukum yang dimiliki oleh masyarakat adat terkait pengakuan atas tanah adat yang telah dikelola. Lalu, yang kedua untuk mengetahui dan menganalisa implikasi pengaturan hutan adat serta penguasaan oleh negara terkait perlindungan hak pada masyarakat adat. Metode penelitian yang digunakan dalam penulisan skripsi ini yaitu Penelitian Normatif yang berarti penelitian ini meneliti berdasarkan pada sisi perundang-undangan itu sendiri, atau dengan kata lain bukan meneliti mengenai gejala sosial akibat perundang-undangan yang ada. Gejala-gejala sosial yang terasa adanya di dalam penulisan skripsi ini belum tentu benar-benar terjadi atau dengan kata lain baru ditakutkan akan terjadi karena peraturan perundang-undangan yang tidak dengan mudah dapat diakses serta diketahui oleh masyarakat hukum adat yang sepanjang hidupnya hanya berpedoman terhadap hukum adat, bukan hukum nasional. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa pranata hukum mengenai pengakuan hak atas tanah adat yang selama ini telah dikelola oleh masyarakat hukum adat terbukti ada dan lengkap, walaupun memang masih banyak ruang yang dapat dimanfaatkan oleh pemerintah untuk mencoba mengambil alih secara sepihak tanah adat maupun hutan adat yang berada di dalam wilayah masyarakat hukum adat yang selama ini telah dikelola oleh masyarakat hukum adat, namun sejatinya pengakuan atas keberadaan tanah adat maupun hutan adat tersebut adalah nyata dan pemerintah seharusnya menyadari hal tersebut.
