Abstract

ABSTRAK Penelitian yang berjudul Penerapan Prinsip Restorative Justice Sebagai Pelaksanaan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak di Pengadilan Negeri Ngawi bertujuan pertama untuk memahami serta menganalisis tentang bagaimana Penerapan Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak di Pengadilan Negeri Ngawi dan untuk memahami dan menganalisis penerapan prinsip Restorative Justice dalam penanganan perkara pidana anak pada Pengadilan Negeri Ngawi. Metode Penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian Yuridis Empiris yang merupakan penelitian lapang yaitu penelitian terhadap penerpan peraturan perundang-undangan dalam gejala sosial di masyarakat dan literatur berkaitan dengan materi yang dibahas. Berdasarkan hasil penelitian dapat disimpulkan Pertama: Penerapan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak di Pengadilan Negeri Ngawi sudah dilaksanakan sesuai dengan peraturan perundang-undangan baik sisi formil maupun materiil,Kedua: Penerapan sistem restorative justice di Pengadilan Negeri Ngawi sudah berjalan cukup baik, dimana hakim yang bertugas selalu berusaha mewujudkan prinsip resorative justice seperti diversi dalam menyelesaikan perkara pidana anak. Kata Kunci : Anak, Hakim, Pidana Anak, Restorative Justice ABSTRACT The study entitled Application of Restorative Justice Principles as Implementation of Law No. 11 of 2012 concerning the Juvenile Criminal System in the Ngawara District Court aims at first understanding and analyzing how the Application of Law Number 11 of 2012 concerning the Criminal Justice System of Children in the Ngawi District Court and to understand and analyze the application of the principles of Restorative Justice in handling child criminal cases at the Ngawi District Court. The research method used in this thesis uses the Empirical Juridical research method which is a field research that is a study of the implementation of legislation in social phenomena in the community and the literature relating to the material discussed. Based on the results of the study it can be concluded First: Application of Law Number 11 Year 2012 concerning the Juvenile Criminal Justice System in the Ngawi District Court has been carried out in accordance with the laws and regulations both formal and material, Second: The implementation of the restorative justice system in the Ngawi District Court has been running good enough, where the judge in charge always tries to realize the principles of resortative justice such as diversion in resolving child criminal cases.
