Abstract

ABSTRACT The Research entitled Law Aspects of Life Insurance Claims related existence the Decision Supreme Court Republic Indonesian No 124 / PID.B / 2014 / PNG. aims first tfind out the mechanism of insurance claims under applicable Constitution in Indonesia and racio decidendi judges. Decisions of the Supreme Court Judges are binding and have consequences; both negative and positive consequences for those who are severed. So the impact of the decision of the Supreme Court Judge on Lely Lestari as the insured heir of Nica Wijaya. The author wants to provide practical legal justice to Lely Lestari, that is insurance claims from PT. Prudential Assurance Life. The methodology used in writing this scientific paper is normative legal research withan approach through case studies. The author conducts data collection starting from a copy of the Decision of the Ponorogo High Court to the defendant Lely Lestari and the Decision of the Supreme Court. Then author also conducts studies of sources, such as books, articles, research works, theses, theses and dissertations to obtain information so that the writer cantake a attitude and conclusion law. As a conclusion of this scripsi that the Decidency Ratio of the decision of the Supreme Court of the Republic of Indonesia No.124 / PID.B / 2014 / PNG is negligence or fraudulent action or at least the intention to turn back the facts by witness Agus Bangun Saharja S.H as investigator in collaboration work with PT. Pridential Assurance Life and also craftiness as referred in the decision Pengadilan Negeri Ponorogo considered incorrect. The decision of the Supreme Court Judge was also corroborated by the testimony of the witnesses. Keywords: Judge Decision, Insurance Claim, Insurance Constitution. ABSTRAK Penelitian yang berjudul Aspek Hukum Klaim asuransi Jiwa Terkait Adanya Putusan Mahkamah Agung Republik Indonesia No 124/PID.B/2014/PNG yang bertujuan pertama untuk mengetahui mekanisme klaim asuransi berdasarkan Undang – undang yang berlaku di indonesia dan racio decidendi hakim. Putusan Hakim Mahkamah Agung bersifat mengikat dan memiliki konsekuensi; baik konsekuensi negatif maupun positif bagi yang diputus perkaranya. Sehingga dampak putusan Hakim Mahkamah Agung terhadap Lely Lestari sebagai ahli waris tertanggung Nica Wijaya. Penulis ingin memberikan keadilan hukum praktis terhadap lely Lestari, yakni klaim Asuransi dari PT. Prudential Assurance Life. Adapun metodelogi yang digunakan dalam penulisan karya ilmiah ini adalah Penelitian hukum normatif dengan pendekatan studi kasus (case study). Penulis melakukan pengumpulan data mulai dari salinan Putusan Pengadilan Negeri Ponorogo terhadap terdakwa Lely Lestari dan Putusan Mahkamah Agung. Kemudian Penulis juga melakukan kajian dari sumber-sumber, sepeti buku, artikel, karya penelitian, skripsi, tesis dan desertasi guna mendapatkan informasi agar penulis dapat mengambil sebuah sikap dan kesimpulan hukum. Sebagai kesimpulan dari skripsi ini bahwa Rasio Desidendi putusan Mahkamah Agung Republik Indonesia No.124/PID.B/2014/PNG adanya kelalaian atau tindakan pemalsuan atau setidak-tidaknya niat memutar balikan fakta oleh saksi Agus bangun Saharja S.h selaku Investigator yang bekerjasama dengan PT. Assurance Life dan juga tipu muslihat sebagaimana yang dimaksud dalam Putusan Pengadilan Negeri Ponorogo dianggap tidak benar. Putusan Hakim Mahkamah Agung juga dikuatkan oleh keterang para saksi Kata Kunci : Putusan Hakim, Klaim Asuransi, Undang – undang Asuransi
