Abstract

Tesis yang berjudul Pengaturan Dan Tanggung Jawab Penyelenggara Sarana Dan Prasarana Perkeretaapian Dalam Mewujudkan Layanan Publik, bertujuan: Pertama, Mengetahui dan menganalisa pengaturan pelayanan publik PT. KAI sebagai penyelenggara sarana perkeretaapian, kedua, Mengetahui dan menganalisa tanggung jawab PT. KAI dalam penyelenggaraan pelayanan publik sebagai penyelenggara sarana perkeretaapian. Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian Normatif yang merupakan penelitian kepustakaan yaitu penelitian terhadap perundang-undangan dan literatur yang berkaitan dengan materi yang dibahas. Berdasarkan hasil penelitian dapat disimpulkan, Pertama: Pengaturan pelayanan publik PT. KAI sebagai penyelenggara sarana perkeretaapian didasarkan pada Undang-Undang No. 25 Tahun 2005 tentang Pelayanan Publik dan Undang-Undang No. 23 Tahun 2007 tentang Perkeretaapian serta Peraturan perundang-undangan pelaksana lainnya, meliputi penetapan kebijakan umum, kebijakan teknik, penentuan norma, standar, pedoman, kriteria, rencana, dan prosedur, berkaitan penyelenggaraan pelayanan publik oleh PT. KAI dalam pemenuhan sarana perkeretaapian. Kedua, PT. KAI dalam penyelenggaraan pelayanan publik sebagai penyelenggara sarana perkeretaapian bertanggungjawab melayani masyarakat sesuai dengan “standar pelayanan minimum”, yaitu kondisi pelayanan yang harus dipenuhi oleh penyelenggara sarana perkeretaapian yang ditetapkan pemerintah. Sebagai contoh: penetapan tarif angkutan pelayanan klas ekonomi yang merupakan bentuk kewajiban pelayanan publik (Public Service Obligation), yaitu tarif yang terjangkau untuk masyarakat yang dilaksanakan oleh penyelenggara sarana perkeretaapian. Thesis entitled Arrangement and Responsibility of Railway Infrastructure and Infrastructure Providers in Realizing Public Service, aims: First, Knowing and analyzing the public service arrangements of PT. KAI as the organizer of the railroad facilities, secondly, Knowing and analyzing the responsibilities of PT. KAI in the administration of public services as a provider of railways facilities. The research method used in this thesis uses the Normative research method which is a library research that is research on legislation and literature relating to the material discussed. Based on the results of the study it can be concluded, First: PT. KAI as the organizer of the railway facility is based on Law No. 25 of 2005 concerning Public Services and Law No. 23 of 2007 concerning Railways and other implementing regulations, including the establishment of general policies, technical policies, determination of norms, standards, guidelines, criteria, plans and procedures, relating to the implementation of public services by PT. KAI in meeting the railways facilities. Second, PT. KAI in the implementation of public services as the organizer of the railway facility is responsible for serving the public in accordance with the "minimum service standards", namely the conditions of service that must be met by the organizer of the railroad facilities established by the government. For example: the determination of tariffs for economy class service transportation which is a form of public service obligation (i.e. public service obligation), which is an affordable tariff for the community that is carried out by the railway operator.
