Abstract

ABSTRACT The study entitled juridical analysis of food home industry companies on ownership of quality certificates, with the object of study in Jek Adem Ice Crean and Petis Mantap, aimed first to analyze the causes of the food household industry Jek Adem Ice Cream and Petis Mantap not having food quality certificates. The second objective is to find out the legal consequences that can be accepted by food household industry companies Jek Adem Ice Cream and Petis Mantap. The research method used in this paper uses empirical normative methods, which refer to regulations relating to consumer protection, food and guidelines for managing quality certificates, and data obtained from observations and interviews with related institutions. The research method is supported by the theory used, namely the theory of legal protection and law enforcement theory. Based on the results of the study, it can be concluded that the first is the inhibiting factors for food home industry companies which are divided into 3, namely, compliance, fulfillment of standards and other burdens after having a food quality certificate. These factors are increasingly burdened with the attitude of entrepreneurs who cannot be directed towards good, even though the entrepreneurs include being aware and aware of their obligations. The second conclusion is that the legal consequences are divided into 2, namely the consequences when carrying out the obligations of the law in the form of fulfillment of rights and consequences when violating laws in the form of criminal, civil or administrative sanctions. The whole of the requirements, standards that must be achieved and other burdens which after having a quality certificate and also the legal consequences when not having a quality certificate are contained in Law Number 8 of 1999 concerning Consumer Protection, Law Number 18 of 2012 concerning Food, Government Regulations Number 28 of 2004 concerning Food Safety, Regulation of the Head of Drug and Food Control Agency Number 13 of 2016 concerning Claims on Labels and Advertisement of Processed Foods and Regulations of Agency Heads Drug and Food Control Number HK.03.1.23.04.12.2205 of 2012 concerning Guidelines for Giving Household Industry Food Production Certificates.
