Abstract

ABSTRAK Penelitian ini bertujuan untuk menganalisis prinsip-prinsip mediasi dalam penyelesaian perkara kecelakaan lalu lintas. Permasalahan dalam penulisan ini adalah sebagai berikut: (1) Bagaimana prinsip-prinsip dalam pelaksanaan mediasi sebagai alternatif penyelesaian perkara dalam kecelakaan lalu lintas? (2) Bagaimana upaya para pihak dalam menyelesaikan kecelakaan lalu lintas? Penelitian ini menggunakan pendekatan masalah yuridis normatif. Sumber bahan hukum yang digunakan berupa bahan hukum primer dan bahan hukum sekunder. Hasil penelitian adalah: (1) Prinsip-prinsip mediasi sebagai alternatif penyelesaian perkara kecelakaan lalu lintas oleh Polres Bogor Kota dilanjutkan dengan langkah-langkah sebagai berikut: a. Mediasi dapat dilakukan pada perkara lalu lintas dengan adanya kerugian material dan luka fisik ringan yang dialami oleh korban: b. Adanya kesepakatan bersama kedua belah pihak yang berperkara yakni korban dan tersangka maupun keluarganya terkait kasus kecelakaan lalu lintas yang dialami serta ganti ruginya. Kata Kunci: mediasi, kecelakaan lalu lintas, alternatif penyelesaian perkara ====================== ABSTRACT This study aims to analyze the principles of mediation in the settlement of traffic accident cases.The problems in this writing are as follows: (1) What are the principles in the implementation of mediation as an alternative to settlement of cases in traffic accidents? (2) What are the efforts of the parties to resolve traffic accidents? This study uses a normative juridical problem approach. Sources of legal material used in the form of primary legal materials and secondary legal materials. The results of the study are: (1) The principles of mediation as an alternative to the completion of a traffic accident case by the Bogor City Police, followed by the following steps: a. Mediation can be carried out on traffic cases with material loss and minor physical injury suffered by the victim: b. There is a mutual agreement between the two litigants, namely the victims and suspects and their families in the case of traffic accidents that are experienced and compensation.
