Abstract

ABSTRACT The research entitled Analysis of execution decisions not executed (decree number 1080 / Pdt.G / 2015 / PN.Sby) To know and analyze whether the judge's verdict in giving decision in case 1080 / Pdt.G / 2015 / PN.Sby accordingly with applicable regulations as well as to know and analyze what the legal consequences of land use for the establishment of residential buildings on the land rights of others. The research method used is normative, that is research by using approach of legislation and drawing legal principles related to decision immediately. Based on the result of research, it can be concluded firstly: That the reason of Judge in decision number 1080 / Pdt.G / 2015 / PN.Sby is still less precise, because there are rules in SEMA number 3 year 2000 less attention, that judge should pay more attention to decision immediately rulings that can be executed first and therefore if executed then there should be goods or collateral that the same value to the goods to be executed. And from the verdict there is no goods or guarantees of equal value to the goods being executed. In the case of wishing to erect a building on land not a property right, resulting in a legal matter against the parties claiming that the land which the building was building belongs to it.
