Abstract

ABSTRAK Penelitian yang berjudul Penundaan Pemilihan Umum Melalui Putusan Pengadilan Negeri bertujuan untuk menganalisis apakah sistem keadilan elektoral dalam pemilu mengatur mengenai penundaan pemilu dan sekaligus bertujuan untuk memperoleh pemahaman yang lebih konkrit apakah Pengadilan Negeri memiliki kewenangan dalam mengadili sengketa pemilu, khususnya melakukan Penundaan Pemilu. Penelitian ini menggunakan tipe penelitian hukum normatif (legal research, rechtsonderzoek), dengan menitikberatkan pada implementasi hukum khususnya berkaitan dengan pemilu dan kewenangan pengadilan, serta menggunakan pendekatan kasus, yakni Putusan Nomor: 757/Pdt.G/2022/PN Jkt.Pst. Penelitian ini tidak dimaksudkan untuk melakukan verifikasi menguji hipotesis. Dengan demikian penelitian hukum tidak dikenal adanya hipotesis, demikian pula tidak mengenal istilah data. Adapun dalam penelitian hukum digunakan istilah bahan hukum. Hasil penelitian ini menunjukkan bahwa UUD NRI 1945 dan UU Pemilu tidak mengatur mengenai konsep penundaan pemilu, mengingat konstitusi secara tegas mengatur bahwa Pemilu dilaksanakan setiap lima tahun sekali. Namun demikian, UU Pemilu mengatur adanya pemilu lanjutan dan pemilu susulan. Selain itu, hasil penelitian ini menunjukkan bahwa Pengadilan Negeri tidak berwenang mengadili sengketa proses, bahkan melakukan penundaan pemilu sekalipun. Bahwa agar tidak terjadi lagi Putusan Penundaan Pemilu dikemudian hari, maka Mahkamah Agung harus memberikan penyuluhan dan bimbingan teknis kepada para hakim Pengadilan Negeri. Kata Kunci : Penundaan Pemilu, Pemilu, Kewenangan ABSTRACT The research entitled Postponement of General Elections through District Court Decisions aims to analyze whether the electoral justice system in elections regulates election postponements and at the same time aims to gain a more concrete understanding of whether District Courts have the authority to adjudicate election disputes, especially carrying out Election Postponements. This research uses a type of normative legal research (legal research, rechtsonderzoek), with an emphasis on legal implementation, especially relating to elections and court authority, and uses a case approach, namely Decision Number: 757/Pdt.G/2022/PN Jkt.Pst. This research is not intended to carry out verification to test hypotheses. Thus, legal research does not recognize the existence of hypotheses, nor does it recognize the term data. Meanwhile, in legal research the term legal materials is used. The results of this research show that the 1945 Constitution of the Republic of Indonesia and the Election Law do not regulate the concept of postponing elections, considering that the constitution strictly stipulates that elections are held every five years. However, the Election Law regulates the existence of follow-up elections and supplementary elections. Apart from that, the results of this research show that the District Court has no authority to adjudicate process disputes, even to postpone elections. That in order to prevent further Election Postponement Decisions from occurring in the future, the Supreme Court must provide counseling and technical guidance to District Court judges.
