Abstract

ABSTRAK Peristiwa Salah Tangkap merupakan sebuah kesalahan dalam proses pelaksanaan penangkapan yang dilakukan oleh aparat kepolisian. penangkapan diatur secara rinci dalam KUHAP, akan tetapi jika yang bersangkutan adalah seorang anak dibawah umur maka diberlakukan undang-undang khusus yaitu Undang-undang nomor 11 tahun 2012 tentang sistem peradilan pidana anak. dimana ditegaskan terkait asas serta penerapanya harus memperhatikan perlindungan dan kepentingan anak. semua aparat penegak hukum wajib tunduk pada ketentuan pada sistem peradilan pidana anak dan melindungi hak-hak anak. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan studi kepustakaan menggunakan bahan hukum primer dan bahan hukum sekunder. Adapun cara analisa bahan hukum yang peneliti gunakan adalah interpretasi sistematis dengan cara menghubungkan aturan yang satu dengan yang lain dan interpretasi autentik dengan cara memahami makna kata yang berikan oleh pembuat undang-undang yang digunakan pada peraturan yang bersangkutan. Hasil penelitian menunjukan bahwa terdapat perlindungan hukum bagi seorang anak yang berkonflik dengan hukum yang diatur dalam undang-undang, dimana aparat kepolisian yang melakukan salah tangkap dan tidak mengindahkan ketentuan sistem peradilan pidana anak dapat dikenakan sanksi sebagaimana diatur dalam Peraturan Kepolisian Nomor 7 Tahun 2022 dan Peraturan Pemerintah Nomor 2 Tahun 2003 terkait disiplin anggota kepolisian. selain itu, terhadap korban anak salah tangkap dapat melakukan upaya pengajuan rehabilitasi dan ganti rugi yang tata caranya diatur Surat Keputusan Menteri Keuangan Nomor. 983/KMK.01/1983, membahas terkait proses untuk mengatur pembayaran ganti kerugian kepada korban salah tangkap atau kesalahan hukum. Kata Kunci: Salah tangkap, Anak, Aparat kepolisian. ABSTRACT Wrongful Arrest Incidents refer to errors in the process of executing arrests made by police officers. Arrest procedures are detailed in the Criminal Procedure Code, but if the individual involved is a minor, a specific law is applied, namely Law Number 11 of 2012 on the Juvenile Criminal Justice System. This law emphasizes principles and applications that must consider the protection and interests of the child. All law enforcement officers are obliged to adhere to the provisions of the juvenile criminal justice system and protect children's rights. This study employs a normative research method with a literature study approach using primary legal materials and secondary legal materials. The method of legal material analysis used by the researcher is systematic interpretation by connecting one rule to another and authentic interpretation by understanding the meaning of words given by the lawmakers used in the relevant regulations. The research results indicate that there is legal protection for children in conflict with the law as regulated in the law. Police officers who commit wrongful arrests and disregard the provisions of the juvenile criminal justice system can be sanctioned as regulated in Police Regulation Number 7 of 2022 and Government Regulation Number 2 of 2003 regarding police member discipline. Additionally, child victims of wrongful arrests can pursue rehabilitation and compensation efforts, the procedures of which are regulated in the Decree of the Minister of Finance Number. 983/KMK.01/1983, discussing the process for arranging compensation payments to victims of wrongful arrests or legal errors.
