Abstract

ABSTRACT Medical consent or Informed Consent is a statement by the patient, in this case as a health consumer or his/her legal representative, which contains the form of approval for the medical action plan proposed by the doctor after receiving sufficient information to be able to make an approval or refusal. The purpose of medical approval is, among other things, to protect patients, in this case as a form of health consumer protection against all medical procedures carried out without the patient's knowledge, and to provide legal protection to doctors against unexpected and negative consequences, for example against the risk of unexpected treatment. may be avoided even though the doctor has tried his best and acted very carefully and thoroughly. The author sees that there are main problems regarding medical approval for consumer protection. These problems consist of the juridical implications of refusing medical approval (informed consent) for the patient's risks and legal liability for the doctor's actions after approval of medical treatment. In answering this problem, the author conducted normative juridical research or library legal research, to obtain secondary data consisting of primary legal materials and secondary legal materials in the form of laws and legal experts. The data obtained was analyzed using grammatical and systematic interpretation methods using deductive thinking patterns. The data collection technique used is the library study technique. Based on the results of the analysis that has been carried out, it can be concluded that the current medical approval meets the requirements for valid medical approval, in accordance with statutory regulations. In this legal literature research, the researcher suggests that there is still a need for improvements in administrative columns and global validation of the form of the medical consent form, the legal implications of refusing medical treatment and resolving legal liability for medical action regarding patient risks.
