Abstract

The research entitled WITCHCRAFT OFFENSE IN THE PERSPECTIVE OF LAW NO.1 OF 2023 CONCERNING THE CRIMINAL CODE AS AN EFFORT TO DECOLONIZE. Aims to know and increase public understanding of how the perspective of Law No. 1 of 2023 concerning the Criminal Code in tackling witchcraft crimes. In addition, the content of Article 252 of Law No. 1 of 2023 concerning the Criminal Code also reflects the government's efforts in realizing the decolonization of legal products in Indonesia. Because in fact, many people feel aggrieved by witchcraft. The research method used in this thesis uses the Normative legal research method which is literature research, namely research on laws and regulations and literature or reading materials related to the material discussed. Based on the results of research, it can be concluded that Article 252 regarding offering or providing services as witchcraft workers actually intends to expand the reach of Article 250. Offenses that are scattered and regulated in several articles of the Criminal Code include: article 333 paragraph (4), article 349, article 415, article 417, article 252, article 253, article 254, article 255, article 256, article 257, article 258, article 259. Then Efforts to criminalize acts regarding witchcraft in general aim to prevent the occurrence of public fraud in general that can be carried out by people who claim to have supernatural powers to help commit crimes (false shamans), prevent the community from looking for parties who claim to have supernatural powers to help commit crimes, prevent the community from taking the law into their own hands (eigenrichtin) against people who are considered to have supernatural powers, and encourage the community Efforts to criminalize acts regarding witchcraft in general aim to prevent the occurrence of public fraud in general. In addition, to put forward the value of materialism as a form of eliminating conservative cultures such as witchcraft and realizing decolonization efforts.
