Abstract

In this research, there are two problems formulated, namely: what are the forms of phishing crimes with the modus operandi of messages in the form of APK files; and what is the responsibility for the criminal act of Phishing with the modus operandi of messages in the form of APK files. The research method used in this research is Normative law. The results of this research show that phishing with the modus operandi of messages in the form of .APK uses two phishing approaches which the perpetrator combines to carry out the crime, namely creating a fake web (web forgery) and combining it with a conversation application approach (chat phishing). Criminal liability for perpetrators of APK file phishing who are proven to have committed a phishing crime can be held criminally responsible because they have committed violations in the form of: (1) Crime of fraud, which can be punished according to Article 378 of the Criminal Code and Article 28(1) jo. Article 45(2) ITE Law; (2) The crime of document forgery, which can be punished according to Article 263 of the Criminal Code and Article 35 jo. Article 51(1) ITE Law; (3) The crime of breaking into another person's banking account, which can be punished according to Article 30 jo. Article 46 Article 46 of the ITE Law; (4) The crime of theft, which can be punished according to Article 362 of the Criminal Code and Article 32 jo. Article 48 of the ITE Law regulates violations of transferring data belonging to other people or public property.
