Abstract

Masih banyaknya penumpukkan atau tunggakan sengketa di pengadilan melalui peradilan umumnya, hal ini tidak sesuai dengan asas, peradilan cepat, sederhana, dan biaya ringan. Apabila asas tersebut belum terlaksana dengan baik akan berdampak terhadap menumpuknya sengketa di pengdilan. Dengan menumpuknya sengketa yang banyak di pengadilan berarti pencari keadilan belum dapat terlayani dengan baik. Dengan banyaknya penumpukan sengketa di pengdilan, maka perlu alternatif penyelesaian sengketa yang dapat mengurangi penumpukan sengketa di pengadilan. Pentingnya topik penelitian ini, untuk memberikan pemahaman bagi penegak hukum dan pencari kedilan bahwa penyelesaian sengketa tidak hanya melalui pengadilan, tetapi dapat juga diselesaiakan di luar pengadilan melalui mediasi. Penelitian ini dikaji dengan menggunakan kajian hukum normatif, spesifikasi penelitian bersifat kualitatif, Sumber data sekunder dan menggunakan analisis datakualitatif. Sengketa yang terjadi di masyarakat tidak harus diselesaikan di pengadilan, bahkan boleh langsung diselesaiakan dengan menggunakan mediasi sebagai alaternatif penyelesaian sengketa. Mediasi sebagai alternatif dalam penyelesaian sengketa sangat efektif untuk mengurangi penumpukan sengketa di pengadilan. Mediasi merupakan penyelesaian yang menanamkan kepada pihak yang menang tidak merasa menang dan pihak yang kalah tidak merasa pada pihak yang kalah. Jadi mediasi mengedepankan win-win solution bagi para pihak. Kata kunci: alternatif, di luar pengadilan, mediasi, sengketa. This research was studied using studies normative law, qualitative research specifications, secondary data sources and using data analysis qualitative. Disputes that occur in society do not have to be resolved in court, they can even be resolved directly resolved by using mediation as an alternative dispute resolution tool. Mediation as Alternative dispute resolution is very effective in reducing the buildup of disputes in court. Mediation is a solution that ensures that the winning party does not feel like they have won or the other party The loser doesn't feel like he's on the losing side.
