Abstract

Penelitian ini bertujuan untuk mengetahui implementasi asas kekeluargaan di koperasi simpan pinjam indosurya. Hal ini berdampak buruk bagi nasabah yang dirugikan oleh ksp indosurya. Metode penelitian ini menggunakan jenis penelitian normatif dengan pendekatan perundang undangan dan pendekatan konseptual. Penelitian ini dilakukan dengan mengacu pada fakta berupa peristiwa yang ada di masyarakat, bahwa koperasi simpan pinjam indosurya tidak bisa melaksanakan asas kekeluargaan. Hasil penelitian menunjukkan bahwa koperasi simpan pinjam indosurya telah gagal dalam implementasi asas kekeluargaan. Kesimpulan yang diperoleh dari penelitian ini yaitu, bahwa koperasi simpan pinjam indosurya tidak melaksanakan pengaturan yang berlaku pada Undang-Undang Permenkop No 8 Tahun 2023. Maka bentuk dari perlindungan hukum yang didapat oleh anggota koperasi atas tidak terlaksananya asas kekeluargaan terbagi menjadi dua yaitu, perlindungan hukum melalui preventif dan perlindugan hukum represif. This has a bad impact on customers who are harmed by ksp indosurya. This research method uses normative research with a statutory approach and a conceptual approach. This research was conducted with reference to facts in the form of events in the community, that the indosurya savings and loan cooperative could not implement the principle of kinship. The results showed that the indosurya savings and loan cooperative had failed in the implementation of the principle of kinship. The conclusion obtained from this research is that the indosurya savings and loan cooperative does not implement the applicable regulations in the Permenkop Law No. 8 of 2023. Then the form of legal protection obtained by cooperative members for the non-implementation of the principle of kinship is divided into two, namely, legal protection through preventive and repressive legal protection.
