Abstract
The research entitled Criminalization of Sexual Acts carried out by People Who Are Not Bound by Marriage aims to find out and understand how acts of sexual intercourse by people who are not bound by marriage are regulated regarding the elements and conditions of sexual intercourse, Classification of criminal acts of sexual intercourse, the Concept of Adultery, a Religious Point of View and regulations prohibiting sexual intercourse by people who are not bound by marriage according to law no. 1 of 2023 concerning the Criminal Code (New Criminal Code). The research method used in this thesis is the Normative Research Method which is library research, namely research on statutory regulations and literature related to the material discussed. Based on the results of the first research; that there is a legal controversy regarding the regulation of sexual intercourse/adultery in the old Criminal Code where Article 284 of the Criminal Code is deemed not to provide protection for the community so that with the existence of Law No. 1 of 2023 concerning the new Criminal Code, it can regulate more fully the criminal act of sexual intercourse by an unauthorized person. bound to marriage/adultery.
