Abstract

Peralihan fungsi lahan secara ilegal di Kab. Sumenep marak dilakukan, sedangkan pemerintah daerah Kab. Sumenep Kab. Sumenep selaku lembaga eksekutif tidak menjalankan perannya secara maksimal, sehingga tidak adanya kepastian hukum tentang penyelesaian peralihan fungsi lahan secara ilegal. Penelitian dengan judul “Peran Pemerintah daerah Kabupaten Sumenep Dalam Penyelesaian Peralihan fungsi lahan Secara Ilegal,” ini menganalisa mengenai peran pemerintah daerah Kab. Sumenep Kab. Sumenep dalam penyelesaian peralihan fungsi lahan secara ilegal serta bagaimana implementasi peraturan daerah Kab. Sumenep Nomor 12 Tahun 2013 Tentang Rencana Tata Ruang Wilayah Kabupaten Sumenep Tahun 2013-2033. Penelitian adalah jenis penelitian hukum normatif. Dengan menggunakan dua pendekatan masalah, pertama pendekatan perundang-undangan (statute approach). Kedua, pendekatan konseptual (conceptual approach). Sumber bahan hukum meliputi bahan hukum primer dan sekunder. Bahan hukum dikumpulkan dengan cara menelusuri peraturan perundang-undangan, mengkaji dokumen, penelusuran internet, dan pengayaan literatur hukum. Hasil penelitian ini menemukan bahwa peran pemerintah daerah Kab. Sumenep Kab. Sumenep saat terjadi peralihan fungsi lahan secara ILEGAL dapat dilakukan secara preventif dan/atau peran represif. penyelesaiannya dapat dilakukan dengan prosedur penyelesaian non yudisial dan/atau yudisial. Sedangkan implementasi peraturan daerah Kab. Sumenep Nomor 12 Tahun 2013 Tentang Rencana Tata Ruang Wilayah Kabupaten Sumenep Tahun 2013-2033 masih kurang maksimal karena faktor infrastruktur politik dan suprastruktur politik. Berdasarkan kondisi di atas, maka pemerintah daerah Kab. Sumenep Kab. Sumenep hendaknya membuat produk hukum berupa peraturan daerah tentang tata cara penyelesaian kasus peralihan fungsi lahan secara ilegal, serta membuat kebijakan pemberian sanksi serta pemberlakuan insentif ataupun disinsentif. Kedua, pemerintah daerah Kab. Sumenep untuk segera melakukan upaya perbaikan infrastruktur politik dan suprastruktur politik dengan cara mengadakan pendidikan politik dan peningkatan moralitas. Sumenep, Peralihan fungsi lahan, Implementasi Perda.   ABSTRACT Illegal land use conversion in Sumenep Regency has been rampant, while the local government of Sumenep as the executive body has not effectively fulfilled its functions, resulting in a lack of legal certainty regarding the resolution of illegal land use conversions. This research, entitled "The Role of the Local Government of Sumenep Regency in Resolving Illegal Land Use Conversions," analyzes the role of the local government of Sumenep Regency in resolving illegal land use conversions and the implementation of Regional Regulation No. 12 of 2013 concerning the Spatial Planning of Sumenep Regency for the period 2013-2033. This research is a normative legal research. It uses two problem-solving approaches: the statute approach and the conceptual approach. The legal materials are obtained from primary and secondary legal sources. The legal materials are collected by examining legislation, studying documents, conducting internet searches, and enriching legal literature. The results of this research find that the role of the local government of Sumenep Regency in cases of illegal land use conversion can be carried out through preventive and/or repressive functions. The resolution can be done through non-judicial and/or judicial procedures. Meanwhile, the implementation of Regional Regulation No. 12 of 2013 concerning the Spatial Planning of Sumenep Regency for the period 2013-2033 is still not optimal due to political infrastructure and political superstructure factors. Based on the above conditions, the local government of Sumenep Regency should create a legal product in the form of a regional regulation on the procedures for resolving cases of illegal land use conversion and establish policies for imposing sanctions as well as providing incentives or disincentives. Secondly, the local government should make immediate efforts to improve political infrastructure and political superstructure by conducting political education and enhancing morality.
