Abstract

The purpose of this study is to apply the law, especially in Indonesia, in order to enforce justice and legal certainty in the case of the procurement of apartments and housing in relation to discussing Article 378 of the Criminal Code. Regarding the case study in the Court where this research is used, it aims to study and investigate an incident case regarding an individual person who is the object of research in examining cases on certain events in the community. Which is related to the case study of the Court's decision. Meanwhile, the research approach used is a legal approach in order to discuss legal research problems regarding the inaccuracy of judges in court decisions. Cases of Procurement of Apartments and Housing is a crime against goods and services to other people. Because this behavior is an attempt to deliberately carry out development but to seize some of the property and valuables belonging to consumers under the guise of development investment. However, in fact by the perpetrators made for a business development of PT. Jedine Kurnia Sejahtera.
