Abstract

The study entitled State Recognition and Authority to Establish Trust based on the 1945 Constitution aims first to know and understand and analyze state recognition of the existence of trust based on the 1945 Constitution. Second, to know, understand and analyze the Authority of Determination on the Existence of Trust. Research Methods used in this paper uses research methods that are research Normative Juridical literature, namely research on the laws and regulations-legislation and literature relating to the material discussed. Based on the results of the study can be concluded First: that the Recognition of Belief according to the Basic Law of 1945 contained in Article 28E paragraph (2) related to belief, Article 28I paragraph (1) related to religious rights is a human right that cannot be reduced under any circumstances, Article 28J paragraph (2) related to human rights and freedoms are subject to restrictions including religious values. Second: After the enacting of MPR Decree Number IV / MPR / 1978 states that belief is not part of religion but culture. Following up on the policy issued Presidential Regulation No. 91 of 2011 concerning the Establishment and Organization of the Ministry of State restored the field of culture to be reunited in the field of Education and formed the Ministry of Education and Culture. The Ministry of Education and Culture is authorized to supervise and conduct the construction of trust through the Directorate of Fostering Trust in God Almighty and Tradition.
