Abstract

ABSTRAK Produksi limbah bahan berbahaya dan beracun (B3) terus bertambah besar tidak hanya di negara maju namun juga di negara berkembang termasuk di Indonesia. Untuk menyikapi hal tersebut pemerintah mengeluarkan beberapa regulasi, salah satunya yakni Peraturan Pemerintah Nomor 101 Tahun 2014 tentang Pengelolaan Limbah Bahan Berbahaya dan Beracun. Dalam kenyataannya, pelanggaran akan peraturan tersebut masih banyak terjadi. Pelanggaran terjadi di setiap jenis aktifitas pengelolaan limbah B3. Salah satu pelanggaran pengolahan limbah bahan berbahaya dan beracun dikawasan militer Pangkalan Utama Angkatan Laut V Surabaya. Limbah yang dihasilkan di Pangkalan Utama Angkatan Laut V Surabaya terdiri dari oli bekas dan sisa bahan bakar minyak (BBM). Limbah B3 tersebut tidak memiliki izin pengelolaan dari Menteri Negara Lingkungan Hidup dan pengelolaannya tidak sesuai dengan Undang - Undang yang berlaku, yang bisa mencemari lingkungan hidup. Tesis ini menggunakan penelitian yuridis normatif karena menitik beratkan pada meneliti asas - asas hukum, sistematis hukum, dan sinkronisasi hukum dengan cara menganalisanya. Kata Kunci: Limbah bahan berbahaya dan beracun (B3), pelanggaran pengolahan limbah, peraturan perundangan. ABSTRACT The production of hazardous and toxic waste (B3) continues to grow, not only in developed countries but also in developing countries including Indonesia. To address this, the government issued several regulations, one of which is Government Regulation Number 101 of 2014 concerning Management of Hazardous and Toxic Waste. In reality, there are still many violations of these regulations. Violations occur in every type of B3 waste management activity. One of the violations of the processing of hazardous and toxic waste in the military area of the V Surabaya Navy Main Base. The waste generated at the Main Base of the Navy V Surabaya consists of used oil and remaining fuel oil (BBM). The B3 waste does not have a management permit from the State Minister for the Environment and its management is not in accordance with the applicable laws, which can pollute the environment. This thesis uses normative juridical research because it focuses on examining legal principles, legal systems, and legal synchronization by analyzing them.
