Abstract

ABSTRAK Tentara Nasional Indonesia (TNI) sebagai alat pertahanan Negara merupakan institusi yang bertanggung jawab terhadap kedaulatan NKRI dari gangguan dari luar maupun rong-rongan dari dalam negeri, TNI juga merupakan satu-satunya institusi yang mengawaki Alutsista yang mematikan. Oleh karena itu TNI harus Solid dan Profesional, serta memegang teguh disiplin keprajuritan demi keberhasilan tugus pokok dan fungsinya. Untuk itu perlu dibuat aturan hukum untuk mengatur kehidupan prajurit. Dengan dikeluarkanya Undang-Undang Nomor 25 Tahun 2014 tentang Hukum Disiplin Militer, maka TNI akan menjelma menjadi Tentara yang Profesional. Penelitian ini juga bertujuan untuk mengetahui bagaimana relevansi Asas Kepentingan Militer terhadap kedisiplinan prajurit dalam penjatuhan hukuman disiplin, serta bagaimana eksistensi Asas Kepentingan Militer dalam penjatuhan hukuman disiplin dihadapkan dengan profesionalitas TNI. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normative, yang meneliti hukum berdasarkan pendekatan kasus. Bahan hukum yang digunakan meliputi bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil penelitian diketahui bahwa peranan Asas Kepentingan Militer dalam penjatuhan hukum disiplin sangatlah dikedepankan dalam institusi TNI. Diketahui bahwa keadilan, kepastian dan perlindungan hukum adalah hak asasi setiap manusia yang hidup di dunia, termasuk anggota miiter itu sendiri. Namun Asas Kepentingan Militer lebih diutamakan di intern TNI guna menjaga profesionalitas yang harus dikedepankan daripada mendahulukan kepentingan individu. Diharapkan untuk masa yang akan datang TNI lebih profesional dan tetap solid sebagai alat pertahanan negara namun tetap berpedoman pada hukum dan tidak mengabaikan kepentingan hukum personelnya yang juga merupakan manusia biasa yang harus dilindungi hak asasinya terutama masalah penegakan hukum. Kata Kunci: Hukum Disiplin, Profesional, Asas Kepentingan Militer ABSTRACT The Indonesian National Armed Forces (TNI) as a means of state defense is an institution that is responsible for the sovereignty of the Republic of Indonesia from interference from outside and internal interference, the TNI is also the only institution that oversees the deadly Alutsista. Therefore, the TNI must be solid and professional, and uphold soldiering discipline for the success of its main tasks and functions. For this reason, it is necessary to make legal rules to regulate the lives of soldiers. With the issuance of Law Number 25 of 2014 concerning Military Discipline Law, the TNI will be transformed into a Professional Army. This study also aims to determine the relevance of the Principle of Military Interest to the discipline of soldiers in imposing disciplinary penalties, and how the existence of the Principle of Military Interest in imposing disciplinary penalties is faced with the professionalism of the TNI. The research method used in this study is a normative legal research method, which examines law based on a case approach. The legal materials used include primary legal materials and secondary legal materials. Based on the results of the study, it is known that the role of the Military Interest Principle in imposing disciplinary laws is highly prioritized in the TNI institution. It is known that justice, certainty and protection of the law are the basic rights of every human being living in the world, including members of the military themselves. However, the principle of military interest is prioritized within the TNI in order to maintain professionalism which must be prioritized rather than prioritizing individual interests. It is hoped that in the future the TNI will be more professional and remain solid as a means of state defense but still be guided by the law and do not neglect the legal interests of its personnel who are also ordinary human beings whose human rights must be protected, especially in law enforcement.
