Abstract

ABSTRAK Pemalsuan Surat Keterangan Domisili pada pendaftaran peserta didik baru dengan sistem zonasi merupakan suatu bentuk kejahatan digunakan oleh orang tua calon siswa dalam penerimaan peserta didik baru karena diberlakukannya sistem zonasi. Para orang tua menggunakan surat keterangan domisili palsu agar anaknya masuk zonasi sekolah yang diinginkan. Surat Keterangan Domisili dikeluarkan oleh otoritas berwenang namun datanya tidak sesuai dengan kenyataan. Tujuan penelitian ini untuk mengetahui faktor penyebab terjadinya pemalsuan Surat Keterangan Domisili pada pendaftaran peserta didik baru dengan sistem zonasi, dan untuk mengetahui cara menanggulangi terjadinya pemalsuan Surat Keterangan Domisili pada pendaftaran peserta didik baru dengan sistem zonasi. Metode yang digunakan dalam penelitian ini yakni menggunakan metode penelitian empiris dengan melakukan penelitian secara langsung untuk mengumpulkan semua informasi yang berhubungan dengan penelitian ini, baik dengan wawancara dengan pihak terkait, maupun dengan pengamatan secara seksama terhadap objek penelitian. Hasil penelitian yang dilakukan yaitu faktor-faktor yang menyebabkan terjadinya kejahatan pemalsuan Surat Keterangan Domisili adalah faktor ekonomi, faktor teknologi, faktor lingkungan, faktor minimnya resiko penjatuhan sanksi pidana. Serta upaya penanggulangan kejahatan pemalsuan Surat Keterangan Domisili dapat dilakukan secara preventif dan represif. Secara Preventif upaya pencegahan sebelum terjadinya kejahatan dan dapat diwujudkan dalam kegiatan-kegiatan penyuluhan hukum untuk mencegah terjadinya pemalsuan Surat Keterangan Domisili pada pendaftaran peserta didik baru dengan sistem zonasi. Secara Represif upaya penanggulangan saat telah terjadinya kejahatan dapat diwujudkan dengan penegakan hukum dengan menjatuhkan sanksi terhadap pelaku dari pembuat Surat Keterangan Domisili palsu sampai penyalurnya dengan pemberian sanksi yang sesuai. Kata Kunci: Pemalsuan, Surat Keterangan Domisili, Sistem Zonasi, Peserta Didik ABSTRACT Falsification of Domicile Certificate on the registration of new students with the zoning system is a form of crime used by parents of prospective students in the acceptance of new students because of the enactment of the zoning system. Parents use fake domicile certificates so that their children enter the desired school zoning. Certificate of Domicile is issued by the competent authority but the data do not correspond to reality. The purpose of this study was to determine the factors that caused the falsification of Domicile Certificate on the registration of new students with the zoning system, and to find out how to overcome the falsification of Domicile Certificate on the registration of new students with the zoning system. The method used in this research is to use empirical research methods by conducting research directly to collect all information related to this research, both by interviewing relevant parties, as well as by careful observation of research objects. The results of research conducted are the factors that cause the occurrence of crime of counterfeiting Certificate of Domicile are economic factors, technological factors, environmental factors, the minimum risk factor for imposing criminal sanctions. And efforts to tackle counterfeiting crime Domicile Certificate can be done preventively and repressively. Preventive efforts to prevent before the occurrence of crime and can be realized in legal counseling activities to prevent the falsification of Domicile Certificate on the registration of new students with the zoning system. Repressively the prevention efforts when the crime has occurred can be realized by law enforcement by imposing sanctions on the perpetrators of the makers of fake Domicile Certificates to their suppliers by providing appropriate sanctions.
