Abstract

Penelitian ini bertujuan untuk mengetahui pertanggungjawaban promosi foto produk online shop yang digunakan oleh akun kpop.collectionn_ di Instagram serta perlindungan hukum atas karya cipta fotografi yang diambil tanpa izin. Promosi foto produk melalui Instagram menimbulkan kerugian. Banyak pihak-pihak dengan mudah mengambil foto produk yang telah diciptakan dan diunggah oleh seseorang kemudian diunduh dan diunggah kembali oleh pihak lain untuk kepentingan promosi usahanya. Kpop.collectionn_ melakukan promosi foto roduk tanpa izin pencipta dan melakukan penipuan kepada para korban dengan menjual merchandise K-pop harga murah. Pengaturan hukum atas karya fotografi yang diunggah demi kepentingan komersial tanpa izin pencipta, telah diatur dalam Undang - Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Larangan dalam memperbanyak atau menggunakan suatu karya cipta termasuk karya fotografi demi kepentingan komersial tanpa izin pencipta atau pemegang hak cipta juga sudah diatur dalam pasal 9 ayat (3) Undang Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Dalam Undang-Undang Nomor 28 Tahun 2014 pasal 9 ayat (3) bahwa “Setiap Orang yang tanpa izin Pencipta atau Pemegang Hak Cipta dilarang melakukan Penggandaan dan/atau Penggunaan Secara Komersial Ciptaan”. Metode penelitian ini menggunakan jenis penelitian normatif dengan pendekatan perundang undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa kpop.collectionn_ terbukti melanggar hak cipta dan harus mengganti kerugian kepada para korban maupun pemilik hak cipta. Pemilik hak cipta berhak mengajukan gugatan perdata ganti rugi kepada Pengadilan Niaga atas pelanggaran hak cipta atau produk hak cipta tersebut. Kata Kunci : Promosi Foto Produk, Hak Cipta, Undang - Undang Nomor 28 Tahun 2014. ix ABSTRACT This study aims to determine the responsibility for promoting online shop product photos used by kpop.collectionn_ accounts on Instagram and the legal protection of photographic copyright works taken without permission. Promotion of product photos via Instagram causes losses. Many parties easily take product photos that have been made and uploaded by someone then downloaded and uploaded again by other parties for the purpose of promoting their business. Kpop.collectionn¬_ promotes product photos without the permission of the creator and commits fraud against victims by selling K-pop merchandise at low prices. Legal arrangements for photographic works uploaded for commercial purposes without the author's permission are regulated in Law Number 28 of 2014 concerning Copyright. The prohibition on reproducing or using a work including photographic works for commercial purposes without the authorization of the creator or copyright holder is also regulated in Article 9 paragraph (3) of Law Number 28 of 2014 concerning Copyright. In Law Number 28 of 2014 article 9 paragraph (3) that "Everyone without the permission of the Creator or Copyright Holder is prohibited from reproducing and / or Commercial Use of Creation". This research method uses normative research with a statutory approach and conceptual approach. The results showed that kpop.collectionn_ was proven to commit copyright infringement and must provide compensation to victims and copyright owners. Copyright owners have the right to file a civil suit for damages to the Commercial Court for copyright infringement or copyright products.
