Abstract

Nurses are an important part of health development. Nurses are also part of the health workforce, even in providing health services, nurses play a very important role, because in everyday life nurses are in direct contact with patients and other health workers. Nurses in carrying out their practice are certainly not free from errors and negligence when carrying out health services, negligence caused by nurses can cause negative things and harm to patients, for which the nurse's actions must be held criminally responsible. On this basis, the researcher conducted a thesis research with the title "Criminal liability for nurses as health workers who make mistakes in health services" with the aim of research to determine the role and working relationship between nurses and other health workers in health services, and to find out criminal liability for nurses as health workers if they make mistakes in health services. The method I used in preparing this thesis was the normative method. This relates to the criminal liability carried out by nurses if they make mistakes in health services according to Law Number 17 of 2023. The normative method is obtained from literature, scientific texts which focus on the criminal liability of nurses if they make mistakes in health services, whether taken from writings. law, articles and journals and books as well as legal research to find out actual legal issues which are considered still relevant to the main problem in this research. Based on the results of research that has been carried out, the results of this research state that (1) The role and working relationship between nurses and other health workers is very important for collaboration in order to create health for patients, the working relationship between nurses and health workers each has different abilities that have the same goal for the health and safety of patients, health workers consist of of the twelve groups which are regulated in article 199 paragraph 1 of Law Number 17 of 2023(2) criminal liability for nurses if they make mistakes in health services must pay attention to two important points, namely the first is the protection of patients as victims who are harmed by nurses and the second is that nurses must be held accountable. the offense is a criminal offense which has been regulated in the relevant laws and regulations.
