Abstract

The research entitled Legal Protection Against Doctors for Services to Patients aims to analyze Legal Protection for Doctors through the efforts that must be made by Doctors if they are found to have made allegations of actions outside standard operating procedures called medical malpractice and know the Doctor's responsibilities as in providing services in it contains several aspects related to ethics and law. The research method used in this thesis uses normative research methods, namely research that is studied through the literature. The approach used in this study is an approach through legislation by reviewing through some of the material studied. The relationship between doctors and patients is a relationship between health service providers and recipients of health services in efforts to increase (promotive), preventative (preventive), treatment (curative) and recovery (rehabilitative) efforts, where there is an agreement in this relationship that binds itself on rights and obligations. Such a relationship is borne by the responsibilities of the parties involved. If the rights and obligations are not fulfilled, this arises because of a conflict that has occurred, the conflict originates from a claim or lawsuit received by the doctor. Doctors' legal protection has been regulated in laws on medical practice, health laws, and also the Codeki which determines the behavior of the medical profession in carrying out their duties. Based on the results of the study it was concluded that, legal protection for medical personnel, especially doctors who are suspected of taking actions outside standard operating procedures in carrying out health services provided to patients, in this study the authors obtained several options to avoid demands and lawsuits that have been given to the medical profession by considering the non-litigation route in the settlement of cases. Just as doctors in providing their services cannot guarantee a good recovery for everyone who has been treated, especially for patients who have chronic illnesses or diseases that are considered at risk.
