Abstract

ABSTRACT The research entitled "Legal Protection of Disadvantaged Health Workers in the Papua Conflict Area, Kiwirok District" aims to know and understand and analyze the legal protection provided to health workers in conflict areas in addition, to know and understand and analyze the mechanisms of legal remedies that can be carried out by health workers who are harmed in the Kiwirok conflict area, Papua. The research method used in this thesis uses the Normative Juridical research method with a statute approach that uses the Law as the basic material in conducting research Based on the results of the discussion, it can be concluded that the attack on Health Workers by Armed Criminal Groups on September 13, 2021, should have health workers protected both preventively and repressively. Legal Protection of Health Workers still regulates legal protection of Health Workers in general as stipulated in Article 88 of Government Regulation Number 67 of 2019 concerning The Management of Health Workers has not yet regulated specifically on conflict events. Health workers who are victims can make legal remedies in a non-litigation manner in the form of administrative and litigation legal remedies by filing a lawsuit at the State Administrative Court. Keywords : Health Workers, Legal Protection for Health Workers, Legal Attempt.   ABSTRAK Penelitian dengan judul “Perlindungan Hukum Terhadap Tenaga Kesehatan Yang Dirugikan Di Wilayah Konflik Papua Distrik Kiwirok” bertujuan untuk mengetahui dan memahami serta menganalisa perlindungan hukum yang diberikan kepada tenaga kesehatan pada wilayah konflik selain itu, untuk mengetahui dan memahami serta menganalisa mekanisme upaya hukum yang dapat dilakukan oleh Tenaga Kesehatan yang dirugikan di wilayah konflik Kiwirok, Papua. Metode Penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian Yuridis Normatif dengan pendekatan statute approach yang menggunakan Undang-Undang sebagai bahan dasar dalam melakukan penelitian. Berdasarkan hasil pembahasan dapat disimpulkan bahwa penyerangan terhadap Tenaga Kesehatan oleh Kelompok Kriminal Bersenjata pada tanggal 13 September 2021 seharusnya Tenaga Kesehatan mendapat perlindungan baik secara Preventif dan Represif. Perlindungan Hukum terhadap Tenaga Kesehatan masih mengatur perlindungan hukum terhadap Tenaga Kesehatan secara umum sebagaimana diatur dalam Pasal 88 Peraturan Pemerintah Nomor 67 tahun 2019 tentang Pengelolaan Tenaga Kesehatan belum ada yang mengatur secara khusus pada dearah konflik. Tenaga Kesehatan yang menjadi korban bisa melakukan upaya hukum secara non-litigasi dalam bentuk upaya hukum administrasi dan litigasi dengan melakukan gugatan pada Pengadilan Tata Usaha Negara.
