ABSTRACT Research entitled “Hidden Disabilities in the Sale and Purchase of Used Cars” is against the background, in everyday life people will not be able to escape from various kinds of needs. The level of community needs is different In carrying out their daily activities the community needs transportations to help its activities, one example is a car. Transportation is very important to in smoothing the wheels of finance while effecting all aspects of life. Transportation was created due very high population mobility. On the basic of that most people who raise money to buy a used car, consider about the money needed to buy a used car this also due to the fact that price for used car are relatively cheaper when compared to new car. The research method used in discussion of this thesis uses the Normative research methods which on the plans and is carried out which reference to the invitations namely Burgerlijk Wetboek (BW) and law Number 8 of 1999 concerning Consumer Protection. Based on the results of the study it can be concluded that: First, the agreement made between the two parties, namely the buyer and seller based on an agreement in the form of an agreement. Existing agreements in the sale and purchase of used cars generally use a named agreement and the agreement is mandatory. Second, the risk is borne by buying and selling used cars under Indonesian law and resolving disputes about buying and selling used cars when there are hidden defects.
