Abstract

ABSTRACT The study, titled Legal Protection of workers affected by termination of employment (PHK) due to Force Majeure in private companies aims to assess/ analyze the legal protection of workers affected by termination of employment (PHK) due to Force Majeure experienced by the private companies. The research method used in this thesis using normative juridical research method, i.e. research that is focused to examine the application of rules or norms in the Normative law, that is the approach that uses the conception of the legislators positivist. This concept views the law is identical with the norms of writing made and promulgated by the agency or the competent authorities. This conception views the law as a system of normative, which is independent, closed and detached from the community life that is real. Based on the results of research that the legal protection of workers affected by Termination of Employment (PHK) due to Force Majuere of the pandemic Virus Covid-19 widely used by private companies but the number that decided the employment relationship so that workers/unions lose make a living day themselves and their families. The need for legal protection of the rights of workers affected by PHK be clarified in order to provide legal certainty. So there will be no more PHK of experienced workers/workers and also the employers take the opportunity to cheat against the state. Keywords: legal Protection, Force Majeure, Termination Of Employment (PHK) ABSTRAK Penelitian yang berjudul Perlindungan Hukum terhadap pekerja/buruh yang terkena pemutusan hubungan kerja (PHK) akibat Force Majeure di perusahaan swasta bertujuan untuk mengkaji/ menganalisis perlindungan hukum pekerja/buruh yang terkena pemutusan hubungan kerja (PHK) akibat Force Majeure yang dialami oleh perusahaan swasta. Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian yuridis normatif, yaitu penelitian yang difokuskan untuk mengkaji penerapan kaidah-kaidah atau norma-norma dalam hukum Normatif, yaitu pendekatan yang menggunakan konsepsi legis positivis. Konsep ini memandang hukum identik dengan norma-norma tertulis yang dibuat dan diundangkan oleh lembaga atau pejabat yang berwenang. Konsepsi ini memandang hukum sebagai suatu sistem normatif yang bersifat mandiri, tertutup dan terlepas dari kehidupan masyarakat yang nyata. Berdasarkan hasil penelitian bahwa perlindungan hukum terhadap pekerja/buruh yang terkena Pemutusan Hubungan Kerja (PHK) akibat Force Majuere dari pandemi Virus Covid-19 banyak dijadikan oleh perusahaan swasta sehingga banyaknya yang diputuskan hubungan kerja nya sehingga pekerja/buruh kehilangan mencari nafkah seharinya sendiri maupun keluarganya. Perlunya perlindungan hukum terhadap hak-hak pekerja/buruh yang terkena PHK diperjelas supaya dapat memberikan kepastian hukum. Sehingga tidak akan ada lagi PHK yang dialami pekerja/buruh dan juga pengusaha mengambil kesempatan ingin berlaku curang terhadap keadaan tersebut.
