Abstract

ABSTRACT Gambling is One of The Court Action. Article 303 paragraph (1) of The Criminal Code. Along with The Development of teknology And informatif. Crime are commited using Computer or The other media. an example is about Online gambling in Article 27 paragraph (2) of Law number 11 of 2008 cocerning ITE. One of the proceedings is the prosecution in accordance with article 1 point 7 of the Criminal Procedure Code. In the prosecution, the preparation of the indictment must be complete, clear and complete. In accordance with applicable laws and regulations The problem of gambling occurs in the Sidoarjo District Court Decision number 62/Pid.b/2017/Pn.Sda. The research method used in this thesis uses a juridical research method that uses a statutory approach, which is a study of court decisions about laws and literature relating to the material discussed. Based on the results of the study it can be concluded that the public prosecutor in the indictment is not in accordance Alt Action because indictment is Article 303 Paragraph (1) on 2 to The Criminal Code whereas, The Action is article 27 Paragraph (2) of The ITE Law. In this case the The Sidoarjo District Court’s decision number 62/Pid.B/2017/PN.Sda has not fulfilled criminal liability in accordance with legal facts that occurred and was revealed in court so that the judge's judgment leads to a criminal ruling against a single defendant. Seiring perkembangan teknologi dan informasi, kejahatan dilakukan dengan menggunakan komputer atau media elektronik lainnya. Contohnya adalah tentang perjudian Online ada di Pasal 27 ayat (2) Undang-Undang Nomor 11 Tahun 2011 Tentang ITE. Salah satu proses acara pidana adalah penuntutan sesuai Pasal 1 butir 7 KUHP. Dalam penuntutan, penyusunan surat dakwaan harus disusun secara cermat, jelas dan lengkap. Sesuai dengan perbuatan dan peraturan yang berlaku. Kasus perjudian terjadi dalam putusan pengadiilan negeri Sidoarjo nomor 62/Pid.B/2017/PN.Sda. Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian yuridis yang menggunakan metode pendekatan statute aproach, yaitu penelitian terhadap putusan pengadilan terhadap dan perundang-undangan serta literatur yang berkaitan dengan materi yang di bahas. Berdasarkan hasil penelitian dapat di simpulkan bahwa jaksa penuntut umum dalam dakwaannya tidak sesuai dengan perbuatannya karena dakwaannya Pasal 303 ayat (1) ke-2 KUHP, sedangkan perbuatannya adalah pasal 27 ayat (2) UU ITE. Dakwaan juga tidak sesuai dengan Pasal 63 ayat (2) KUHP, yang mengandung makna Lex Spesialis Derogat Legi Generalis. Konsekuensi Yuridisnya adalah putusan pengadilan negeri Sidoarjo Nomor 62/Pid.B/2017/PN.Sda tetap dianggap sah dan berkekuatan hukum tetap (incracht ban gewijsde) meskipun terdakwa dirugikan karena terdakwa seharusnya mendapatkan hukuman yang lebih ringan dibandingkan dengan perbuatannya. Dan hakim dalam pertimbangannya tidak mempertimbangkan penerapan prinsip Lex Specialis Derogat Legi Generalis pada Pasal 27 ayat (2) Undang-Undang Nomor 11 Tahun 2011 Tentang ITE. Dengan hal ini, putusan pengadilan negeri Sidoarjo Nomor 62/Pid.B/2017/PN.Sda belum memenuhi pertanggunngjawaban pidana terhadap terdakwa FAJAR ICHSAN ALIAS PANJUL. Kata Kunci: Perjudian Online, Asas Pidana, Surat Dakwaan.
