Abstract

ABSTRAK Tesis ini membahas tentang syarat dan penerapan diversi dalam penyelesaian terhadap tindak pidana yang dilakukan oleh anak. Penelitian ini bertujuan untuk menjawab dua pertanyaan. Pertama, bagaimana syarat pengaturan diversi dalam penyelesaian tindak pidana anak. Kedua, bagaimanakah penerapan diversi dalam penyelesaian tindak pidana anak. Tesis yang berjudul “Penerapan Diversi Dalam Penyelesaian Tindak Pidana Anak” ini merupakan hasil penelitian yuridis normatif untuk menjawab pertanyaan pertanyaan tentang syarat dan penerapan diversi terhadap anak yang berhadapan dengan hukum. Penelitian yang di gunakan adalah yuridis normatif yaitu suatu penelitian yang menganalisis hukum baik yang tertulis dalam buku maupun hukum yang diputuskan hakim melalui proses pengadilan. Penelitian yuridis normatif yaitu penelitian yang berobjekkan hukum normatif berupa asas-asas hukum, sistem hukum, taraf sinkronisasi vertikal dan horizontal. Dari hasil penelitian ini, menghasilkan jawaban yaitu ada tiga syarat yang harus terpenuhi apabila hendak melakukan diversi disetiap tingkatan penegakan hukum yaitu ancaman hukuman dibawah 7 (tujuh) tahun dan bukan pengulangan tindak pidana untuk batas umur anak yang yang dapat dilakukan upaya diversi adalah 12 (dua belas) tahun dan kurang dari 18 (delaapan belas) tahun meskipun anak telah atau pernah kawin. Untuk penerapan diversi di setiap tingkatan penegakan hukum sama yaitu mengacu kepada Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dan setiap tingkat penegakan hukum wajib dilakukan upaya diversi apabila memenuhi syarat-syarat tersebut. Kata kunci : Diversi, Tindak Pidana Anak, Keadilan restoratif. ABSTRACT This thesis discusses the requirements and application of diversion in the settlement of criminal acts by children. This study purposeful to answer two questions. First, how is the requirement regulation for diversion in resolving criminal acts. Second, how is the application of diversion in the settlement of child crime. The thesis entitled "The Application of Diversion in the Settlement of Criminal Acts of Children" is the result of normative juridical research to answer questions about the requirements and application of diversion towards children in conflict with the law. The research used is normative juridical which is a study that analyzes the law both written in books and the law that is decided by the judge through the court process. Normative juridical research is research that has normative law in the form of legal principles, legal system, vertical and horizontal synchronization levels. From the results of this study, produced an answer that there are three conditions that must be met if they want to diversion at every level of law enforcement namely the threat of a sentence under 7 (seven) years and not a repeat of a crime for the age limit of children which can be carried out by the efforts of 12 (twelve) years and less than 18 (eighteen) years even though the child has or has been married. For the application of diversion at every level of same law enforcement that is referring to Law Number 11 years 2012 concerning the Juvenile Justice System and each level of law enforcement must be undertaken diversion efforts if it meets these requirements.
