Abstract

The study, entitled Legal Protection of Consumers of Unlicensed Refill Drinking Water Depots, aims, first, to find out and understand the characteristics of legal protection for consumers who consume drinking water from unlicensed refill depots. Second, to find out and understand the government's authority in the control of unlicensed refill drinking water depots. The research method used in this paper is a normative method, which is a research on the laws and regulations-legislation and literature relating to the material discussed. Based on the results of the study, it can be concluded that, First: Legal protection for consumers who consume drinking water originating from unlicensed refill drinking water depots includes the rights of refill drinking water depot consumers who must be protected by law, the obligations of drinking water depot business owners that must be fulfill for consumers, prohibitions for drinking water depot business owners that must not be done to consumers, and the principle of responsibility by business actors. The entire legal protection is aimed at protecting the rights of unlicensed refill drinking water depots consumers from the actions of its owners that can cause harm to consumers. Second: government’s authority in the control of refill drinking water depots includes the government’s authority based on UUPK, the Dinas Kesehatan’s authority and supervision in terms of the issuing of Sanitation Hygiene Certificate as a requirement for obtaining a business license for drinking water depots, and the Dinas Perindustrian dan Perdagangan’s authority and supervision in terms of issuing a business license for drinking water depots. In addition, there are also the authority of the Badan Perlindungan Konsumen Nasional (BPKN) in terms of efforts to develop consumer protection, and the authority of the Badan Penyelesaian Sengketa Konsumen (BPSK) in terms of resolving consumer disputes by non-litigation process.
