Abstract

Penelitian ini pertama bertujuan untuk mengetahui apakah camat dapat berfungsi sebagai PPAT. Kedua, untuk mengetahui batasan kewenangan camat sebagai PPAT berdasarkan daerah kerjanya dalam pembuatan Akta PPAT. Metode pendekatan dalam penelitian ini adalah pendekatan peraturan perundang-undangan (statue aproach). Suatu penelitian normatif tentu harus menggunakan pendekatan perundang-undangan, karena yang akan diteliti adalah berbagai aturan hukum yang menjadi fokus sekaligus tema sentral suatu penelitian Berdasarkan hasil penelitian dapat ditarik kesimpulan yang pertama, yaitu camat dapat dikatakan sebagai PPAT, dikarenakan berdasarkan ketentuan Pasal 5 ayat (3) Peraturan Pemerintah Nomor 37 Tahun 1998 juncto Pasal 18 ayat (1) Peraturan Menteri Agraria atau Kepala Badan Pertanahan Nasional Nomor 1 Tahun 2006 tentang Ketentuan Pelaksanaan Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Namun pada kenyataannya camat karena jabatannya sebagai PPAT tidak semua bisa menjadi PPAT, dikarenakan Camat dibagi menjadi 2 (dua) yaitu Camat yang Definitif dan juga Camat PLT. Dan kesimpulan kedua, batasan kewenangan camat sebagai PPAT berdasarkan daerah kerjanya dalam pembuatan Akta PPAT yaitu seorang camat selaku PPAT dalam hal objek jual beli tanahnya harus terletak juga pada wilayah kerja seorang camat tersebut. Dan apabila objek jual beli tanah yang dilakukan tidak berada di wilayah kerja seorang camat, maka objek jual beli tanah akan batal demi hukum. ----------------------------------------------------------------- This research first aims to find out whether the Sub-District Head can function as a land titles registrar. Second, to find out the limits of the authority of the Sub-District Head as land titles registrar based on the working area in making the land titles registrar deed. The method of approach in this research is the statutory regulatory approach (statue aproach). A normative research certainly must use a statutory approach, because what will be examined are various legal rules which are the focus as well as the central theme of a study. Based on the results of the research the first conclusion can be drawn, namely the Sub-District Head can be said to be a land titles registrar, because based on the provisions of Article 5 paragraph (3) Government Regulation Number 37 of 1998 juncto Article 18 paragraph (1) Regulation of the Minister of Agrarian Affairs or Head of the National Land Agency Number 1 of 2006 concerning Provisions for Implementing Government Regulation Number 37 of 1998 concerning Regulation of Position of Official for Deed of Land. But in reality, the Sub-District Head because of his position as land titles registrar deed, not all can become the land titles registrar deed, because the Sub-District Head is divided into two namely the Definitive Sub-District Head and the Tasks Executor Sub-District Head. And the second conclusion, the limitation of the authority of the Sub-District Head as land titles registrar deed based on the working area in making the land titles registrar deed is that a Sub-District Head as land titles registrar deed in the case of the object of buying and selling land must also be located in the working area of Sub-District Head. And if the object of sale and purchase of land carried out is not in the working area of a Sub-District leader, then the object of buying and selling land will be null and void.
