Abstract
Dengan munculnya transportasi dengan sistem online memunculkan permasalahan dalam usaha jasa transportasi di bidang usaha transportasi online. Permasalahan tersebut sering terjadi antara pihak konsumen transportasi online dengan jasa angkutan. Dalam hubungan konsumen transportasi online dengan jasa angkutan merupakan suatu perikatan hukum antara dua orang atau dua pihak berdasarkan mana pihak yang satu berhak menuntut sesuatu hal dari pihak yang lain, dan pihak yang lain berkewajiban untuk memenuhi tuntutan itu, karena adanya perjanjian diantara kedua belah pihak, dalam hal ini merupakan hubungan hukum antara pengemudi dan penyedia jasa transportasi online. Dari berbagai karateristik bentuk kerugian dari sudut pandang konsumen maupun penyedia jasa, pengemudi tidak memiliki hubungan kerja dengan perusahaan aplikasi, sehingga pengemudi tidak dapat menuntut hak-hak yang biasa diterima pekerja pada umumnya apabila hubungan kerjasama telah berakhir. Sehingga operator dalam kedudukan hukum tidak dapat bertanggung jawab apabila terdapat kerugian yang dialami pengemudi transportasi online karena operator hanya bertugas sebagai pengoperasi aplikasi. These problems often occur between consumers of online transportation and transportation services. In online transportation consumer relations with transportation services is a legal engagement between two people or two parties based on which one party has the right to demand something from the other party, and the other party is obliged to fulfill that demand, due to an agreement between the two parties, in this case the legal relationship between the driver and the online transportation service provider. Of the various characteristics of loss from the point of view of consumers and service providers, the driver does not have a working relationship with the application company, so the driver cannot claim the rights commonly received by workers in general if the cooperation relationship has ended.
