Abstract

Tesis yang berjudul Perlindungan Hukum Terhadap Risiko Kecelakaan Kerja dan Kematian Pada Guru Tidak Tetap (GTT) dan Pegawai Tidak Tetap (PTT) Di Lingkungan Pendidikan bertujuan: Pertama, Memahami lebih dalam mengenai bentuk perlindungan hukum Guru Tidak Tetap (GTT) dan Pegawai Tidak Tetap (PTT) pada lingkungan pendidikan apabila terjadi risiko kecelakaan kerja dan kematian, kedua, Menghasilkan pemaknaan secara komprehensif siapa yang bertanggungjawab apabila terjadi kecelakaan kerja dan kematian terhadap Guru Tidak Tetap (GTT) dan Pegawai Tidak Tetap (PTT) di lingkungan pendidikan. Berdasarkan hasil penelitian dapat disimpulkan Pertama: Perlindungan Guru Tidak Tetap dan Pegawai Tidak Tetap atas Risiko Kecelakaan Kerja merupakan Hak Asasi Guru Tidak Tetap dan Pegawai Tidak Tetap yang dilindungi dan dijamin oleh Konstitusi, yaitu sebagai perwujudan dan tindak lanjut dari pada Hak Atas Pekerjaan dan Penghidupan yang Layak dan Hak Untuk Mempertahankan Hidup. Sebagai Pekerja, Berdasarkan Undang Undang Badan Penyelenggaraan Jaminan Sosial Ketenagakerjaan (UU BPJS) Guru Tidak Tetap dan Pegawai Tidak Tetap memiliki dan dijamin haknya untuk dilindungi dari berbagai risiko pekerjaan yaitu termasuk diantaranya Risiko Atas Kecelakaan Kerja. Kedua: Pihak Sekolah dan/atau bersama dengan Pemerintah Daerah di Indonesia yaitu dalam hal ini termasuk di Surabaya, sebagai Pemberi Kerja Berdasarkan Undang Undang Badan Penyelenggaraan Jaminan Sosial Ketenagakerjaan (UU BPJS) memiliki kewajiban untuk mendaftarkan Guru Tidak Tetap dan Pegawai Tidak Tetap sebagai Peserta dalam Badan Penyelenggaraan Jaminan Sosial Ketenagakerjaan (BPJS Ketenagakerjaan RI) agar terlindunginya Guru Tidak Tetap dan Pegawai Tidak Tetap dari Risiko Kecelakaan Kerja. The thesis entitled Legal Protection Against the Risk of Work Accident and Death to Non-permanent Teachers (GTT) and Non-Permanent Employees (PTT) in the Educational Environment aims: First, Understand more deeply about the form of legal protection of Non-permanent Teachers (GTT) and Non-Permanent Employees ( PTT) in the education environment if there is a risk of work accident and death, secondly, Generating a comprehensive meaning of who is responsible for workplace accidents and deaths of Non-permanent Teachers (GTT) and Non-Permanent Employees (PTT) in the educational environment. Based on the results of the study it can be concluded First: The Protection of Non-permanent Teachers and Non-Permanent Employees from the Risk of Work Accidents is the Human Rights of Non-Permanent Teachers and Non-Permanent Employees that are protected and guaranteed by the Constitution, namely as an embodiment and follow-up of the Right to Work and Livelihood Feasible and Right to Maintain Life. As a Worker, Under the Manpower Employment Social Security Act (UU BPJS) Temporary Teachers and Non-Permanent Employees have their rights guaranteed to be protected from a variety of occupational risks, including including risks from work accidents. Second: The School and / or together with the Regional Government in Indonesia, in this case including in Surabaya, as an Employer Under the Act of the Managing Social Security Employment Agency (UU BPJS) has an obligation to register Non-permanent Teachers and Non-Permanent Employees as Participants in The Employment Social Security Administration Agency (BPJS Employment of RI) in order to protect Temporary Teachers and Temporary Employees from the Risk of Work Accidents.
