Abstract

Marriage as a Requirement for Returning the Name of Ownership of Land Rights in the Case of Criminal Fraud (A Case Study of Decision No. 748/Pid.B/2005/PN.DPS). This research aims to determine two things, the first to determine the applicability of provisions of substantive criminal law against the crime of deception and to determine the legal considerations by the judge in the decision of the crime of deception case No. 748 / Pid.B / 2005 / PN.DPS. This research was conducted in Badung-Bali and Central Library of Wijaya Kusuma Surabaya University using the techniques of data collection documentation study and interviews. The primary data obtained from interviews of related legal counsel in the case while secondary data obtained from the literature, legislation, documents and expert judgement relating to the discussion of this paper. Based on this research, we concluded that: (1) the Prosecution in making the charges are correct and appropriate that use the charge of Article 378 of the Criminal Code, among the elements that were charged by the Public Prosecutor proven convincingly is Article 378 of the criminal Code but in a criminal prosecution by the public prosecutor, according to the author is still not quite right or does not match the actions of the defendant. (2) Consideration of the law by judges on case No. 748/ Pid.B/2005/PN.DPS in sentencing the defendant is less appropriate and not fair because the judge did not impose criminal according to the actions of the defendant was legally against the law.
