Abstract

ABSTRACT The study, entitled "The Expansion of Post-Decision Objects of the Constitutional Court No.21 / PUU-XII / 2014" aims to determine the setting and scope of pre-trial under the Criminal Procedure Code. and to know the extension of pretrial objects after the Constitutional Court Decision No.21 / PUU-XII / 2014. The research method used in this thesis uses the normative juridical research method which is the research of the literature, that is the research on the legislation and the literature related to the material discussed Based on the result of the research, it can be concluded first: Pre-trial object based on Article 77 KUHAP covers the validity of arrest, detention, cessation of investigation, prosecution, demands for compensation, and rehabilitation. In addition, the Procedures and the process of filing a Pretrial Petition by the Petitioners (victims of wrongful arrest / detention etc.) are not explicitly and specifically regulated in KUHAP. The mechanism of pre-trial filing is provided in Article 77 - Article 83 of KUHAP and PP. 58 of 2010, especially Article 7 to Article 15. Second: The scope of pre-trial objects is not limited to what has been stipulated in Article 1 paragraph (10) jo article 77 of the Criminal Procedure Code, which is limited to the validity of arrest, detention, investigation or termination of prosecution, damages and / or rehabilitation.
