Abstract

ABSTRACT The research entitled Responsibility of Notary on the Establishment of Deed of Partij Based on False Statement According to Law Notary’s Position: (1) How is responsibility of Notariy on the deed of Partij made based on false statement (2) What is the legal effect arising from the Notarial deed based on the false statement. The purpose of this research is to find out how the Notary’s responsibility for the making of deed before the Notary (PartijAkten) based on false statement. Methods of the research that used in this research by using the method of legislation approach, because the discussion in this research was done by means of the analysis of related legislation and using the conceptual approach method where this research did not change from the existing rules. The main source of legal material of legislation, secondary legal material used in this research in the form of books, journals, and electronic articles. Based on the research, it can be concluded that First: Violation or non-compliance with the provisions in Articles concerning the authentic deed resulting in sanctions for Notary and the responsibility of Notary in terms of responsibility of Administration, Criminal responsibility and Civil liabilities. Notary in performing their duties shall be subject to Law Number 30 of 2004 concerning Position of Notary, which has been amended with the coming inti effect of Law Number 2 of 2014 and the Notary Code of Conduct which is the rule applicable to the professional guidance of the Notary profession. A deed containing false information provided by the parties may be canceled. The cancellation of a fine may be made by a Notary if requested by the party who suffered losses.
