Abstract

ABSTRACT The study titled "Characteristics of Video Copyrights In Online Media Youtube" aims first to find out and analyze copyright characteristics in videos uploaded through online media youtube. Secondly to know and analyze the legal protection of video-makers when their videos are captured and re-uploaded by others for commercial purposes. Research Methods used in this thesis using normative research methods which is this research examines the side of the legislation itself. Approach method used in this research is statute approach. Based on the results of research can be concluded first: Video from youtube itself can be categorized as one of the audio visual works. The most visible difference is that in its early development, cinematography can be defined as applied science that discusses the technique of capturing images and simultaneously combining the image so that it becomes a series of images that have the ability to convey ideas and stories, then emerging new technology that is video camera that has been capable of recording images and sounds at once. Based on this, it can be said that film, video, and cinematography are both the elements and forms of audio-visual technology. Secondly: For videos uploaded on the same online youtube media as the existing creation videos very clearly violate UUHC article 1 point 23 as has been explained that piracy is the unauthorized copy of the work and or related product rights and the distribution of the copied goods in question to gain an economic advantage. Third: In order for the copyrighted video to be copyrighted, the video must meet the Standard of Copyright Ability. In the process of video production on online media Youtube must meet several steps, the process includes the discovery and exploration stage of ideas, observations, and research, storyline creation that is the instructions used during the process of shooting / shooting and storyboard is a visual representation of the image to be produced in video, image capture, editing is image editing process that has been obtained, publishing the uploading video to channel Youtube channel. Keywords: Copyright, Cinematography, Youtube ABSTRAK Penelitian yang berjudul “Karakteristik Hak Cipta Video Pada Media Online Youtube” bertujuan pertama untuk mengetahui dan menganalisa karakteristik hak cipta pada video yang diunggah melalui media online youtube. Kedua untuk mengetahui dan menganalisa perlindungan hukum pembuat video saat videonya diambil dan diunggah ulang orang lain dengan tujuan komersial. Metode Penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian normatif yang merupakan penelitian ini meneliti mengenai sisi perundang-undangan itu sendiri. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach). Berdasarkan hasil penelitian dapat disimpulkan pertama: Video dari youtube sendiri dapat dikategorikan sebagai salah satu dari karya audio visual. Perbedaan yang sangat terlihat adalah bahwa dalam perkembangan awalnya, sinematografi dapat didefinisikan sebagai ilmu terapan yang membahas tentang teknik menangkap gambar dan sekaligus menggabung-gabungkan gambar tersebut sehingga menjadi rangkaian gambar yang memiliki kemampuan menyampaikan ide dan cerita, kemudian muncul teknologi baru yaitu kamera video yang sudah mampu merekam gambar dan suara sekaligus. Berdasarkan hal tersebut, dapat dikatakan bahwa film, video, dan sinematografi merupakan unsur sekaligus bentuk dari teknologi audio visual. Kedua: Untuk video yang diunggah di media online youtube yang sama dengan video ciptaan yang sudah ada sangat jelas telah melanggar UUHC pasal 1 angka 23 sebagaimana telah dijelaskan bahwa pembajakan adalah penggandaan ciptaan dan atau produk hak terkait secara tidak sah dan pendistribusian barang hasil penggandaan dimaksud secara luas untuk memperoleh keuntungan ekonomi. Ketiga: Agar karya cipta video dapat dilindungi hak cipta maka video tersebut harus memenuhi Standard of Copyright Ability. Dalam proses produksi video pada media online Youtube harus memenuhi beberapa tahapan, proses tersebut meliputi tahap penemuan dan penggalian ide, observasi, dan riset, pembuatan storyline yaitu petunjuk yang digunakan saat proses pengambilan gambar/syuting dan storyboard yaitu representasi visual dari gambar yang akan diproduksi dalam video, pengambilan gambar, editing yaitu proses pengeditan gambar yang sudah didapatkan, publishing yaitu pengunggahan video ke channel channel Youtube.
