Abstract

The principle of transparency is a fundamental element of consumer protection, particularly in ensuring consumers’ right to obtain accurate, clear, and honest information regarding the products they consume. In practice, transparency in product information is still frequently neglected, especially in relation to the labeling of Bisphenol-A (BPA) content on refillable gallon bottles. BPA is a chemical substance that may migrate from polycarbonate plastic packaging into drinking water and poses potential health risks, particularly to vulnerable groups such as infants, children, and pregnant women. The problem arises when business actors fail to provide adequate labeling or warnings regarding BPA content, resulting in consumers lacking sufficient information to make informed and safe choices. This study aims to examine the implementation of the principle of transparency in consumer protection concerning violations of BPA content labeling on refillable gallon bottles, as well as to analyze the legal remedies available to consumers who suffer losses as a result of such violations. The research employs a normative legal research method using a statutory approach and a conceptual approach. The legal materials used consist of primary legal materials in the form of consumer protection laws and BPOM regulations, as well as secondary legal materials including legal literature and relevant scientific publications. The results of the study indicate that the implementation of transparency principles in BPA labeling on refillable gallon bottles has not been optimal, as reflected by weak regulatory oversight and low compliance among business actors. This study concludes that strengthening regulatory implementation, enhancing government supervision, and improving consumer awareness are essential to ensure effective consumer protection and to guarantee the safety of products consumed by the public.
