Abstract
ABSTRACT One sector that has undergone significant transformation in the digital era is the non-cash payment system through the Quick Response Code Indonesian Standard (QRIS). The implementation of QRIS in Indonesia has increased the efficiency and accessibility of transactions, but it also creates legal risks due to system failures that result in losses for consumers. This research aims first to analyze legal protection for consumers for losses in QRIS payment transactions in Indonesia. Second, to analyze the legal remedies available to consumers who suffer losses due to payment gateway system failures using QRIS. The method used is normative legal research with a statutory approach that refers to relevant laws and regulations. The results show that preventive legal protection through payment system supervision and education to consumers, as well as repressive legal protection in the form of complaints and refund mechanisms, require strengthening to be more effective. This research recommends improving regulations, stricter supervision by Bank Indonesia, and improving the quality of digital infrastructure to ensure legal certainty, justice, and consumer protection in QRIS-based transactions. ABSTRAK Salah satu sektor yang mengalami transformasi signifikan dalam era digital adalah sistem pembayaran non-tunai melalui Quick Response Code Indonesian Standard (QRIS). Implementasi QRIS di Indonesia telah meningkatkan efisiensi dan aksesibilitas transaksi, namun juga menimbulkan risiko hukum akibat kegagalan sistem yang mengakibatkan kerugian bagi konsumen. Penelitian ini bertujuan pertama untuk menganalisis perlindungan hukum bagi konsumen atas kerugian dalam transaksi pembayaran QRIS di Indonesia. Kedua untuk menganalisis upaya hukum yang tersedia bagi konsumen yang mengalami kerugian akibat kegagalan sistem gerbang pembayaran menggunakan QRIS. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) yang mengacu pada peraturan perundang-undangan yang relevan. Hasil penelitian menunjukkan bahwa perlindungan hukum preventif melalui pengawasan sistem pembayaran dan edukasi kepada konsumen, serta perlindungan hukum represif berupa mekanisme pengaduan dan pengembalian dana, memerlukan penguatan agar lebih efektif. Penelitian ini merekomendasikan perbaikan regulasi, pengawasan yang lebih ketat oleh Bank Indonesia, serta peningkatan kualitas infrastruktur digital untuk menjamin kepastian hukum, keadilan, dan perlindungan konsumen dalam transaksi berbasis QRIS.
