Abstract

This study aims to analyze the accountability of perpetrators of fraud using artificial intelligence (AI) technology in Indonesia. With the rapid development of technology, the use of AI in committing fraud is increasing, posing various complex legal issues. This research employs a normative juridical method with a statutory approach and jurisprudential analysis related to AI-based fraud cases. The main issues discussed include how the Indonesian legal framework regulates criminal liability for AI-based fraud perpetrators and the extent to which existing regulations can accommodate such technological advancements. This research is to provide a comprehensive overview of the regulations and application of criminal law in the context of AI-based fraud, as well as to identify weaknesses and gaps in the current legal system. The results of the study indicate that the existing regulations do not fully accommodate the complexity of crimes involving AI and regulatory updates and enhanced law enforcement capacity are needed to address technological challenges in fraud crimes. More specific and technical regulations regarding the use of AI in criminal activities will provide legal certainty and protect society from the risks of advanced technology fraud.
