Abstract

ABSTRACT The research entitled RESPONSIBILITIES OF COMPANIES PROVIDING TELECOMMUNICATIONS SERVICES FOR THE ESTABLISHMENT OF TOWERS, this thesis aims to find out and increase the public's understanding regarding legal protection for communities in areas where towers are installed and to obtain the rights that should be obtained regarding the impact of radiation resulting from the erection of telecommunications towers. . Because of this, there are some people who do not know that they should receive proper protection for detrimental actions resulting from the installation of towers in their community. On the other hand, people do not know the rights they should obtain from the erection of these towers, in this case many people are victims of this. The installation of towers very close to residential areas of dam residents will have a negative impact from the construction of these towers, namely radiation due to the installation of these towers. The research method used in this thesis uses the Normative legal research method which is library research, namely research on statutory regulations and literature or reading materials related to the material discussed. Based on the research results, it can be concluded that Legal Policy approaches Law No. 36 of 1999 concerning Telecommunications, Regional Regulation No. 5 of 2013 concerning Joint Operation of Telecommunication Towers, Government Regulation no. 52 of 2000 concerning the implementation of Telecommunications and Surabaya Mayor Regulation no. 114 of 2021 concerning Guidelines for Controlling Telecommunication Towers in the City of Surabaya, to reduce the risks posed to the public by several telecommunications companies and to enforce the law regarding violations committed by telecommunications companies against the public due to the impact caused by the installation of towers in the community. Keywords: Telecommunication Tower, Responsibility, Radiation Impact ABSTRAK Penelitian yang berjudul TANGGUNG JAWAB PERUSAHAAN PENYEDIAAN JASA TELEKOMUNIKASI ATAS PENDIRIAN MENARA skripsi ini bertujuan untuk mengetahui dan menambah pemahaman masyarakat mengenai perlindungan hukum terhadap masyarakat yang berada diwilaya pemasangann menara dan untuk memperoleh hak – hak yang seharusnya diperoleh atas dampak radiasi yang ditimbulkan akibat pendirian menara telekomunikasi tersebut . Karena hal ini ada beberapa Masyarakat yang tidak mengetahui dirinya seharusnya mendapatkan perlindungan yang layank atas perbuatan yang merugikan akibat pemasangan menara dilingkungan masyarakat tersebut disisi lain masyarakat tidak mengetahui hak – hak yang seharusnya diperoleh atas pendirian menara tersebut, dalam kasus ini banyak masyarakat yang menjadi korban atas pemasangan Menara yang sangan berdekatan dari pemukiman warga dam mendapatkan dampak negative dari pendirian menara tersebut yakni radiasi akibat pemasangan menara tersebut. Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian hukum Normatif yang merupakan penelitian kepustakaan, yaitu penelitian terhadap peraturan perundang – undangan dan literatur atau bahan bacaan yang berkaitan dengan materi yang dibahas. Berdasarkan hasil penelitian yang dapat disimpulkan Kebijakan Hukum melalui pendekatan Undang – Undang No.36 Tahun 1999 tentang Telekomunikasi,Peraturan Daerah No. 5 Tahun 2013 Tentang Pentelengaraan Menara Telekomunikasi Bersama, Peraturan Pemerinta No. 52 Tahun 2000 Tentang penyelengaraan Telekomunikasi dan Peraturan Walikota Surabaya No. 114 Tahun 2021 Tentang Pedomom Pengendalian Menara Telekomunikasi di Kota Surabaya, untuk mengurangi resiko yang diperoleh masyarakat atas beberapa perusahaan telekomunikasi serta penegak hukum atas terjadinya pelanggaran yang dilagukan perusahaan telekomunikasi kepada masyarakat karena dampak yang ditimbulkan akibat pemasangan menara dilingkungan masyarakat.
