Abstract

Skripsi dengan judul “Perlindungan Hukum Teradap Warga sipil Terkait Kepemilikan Dan Penggunaan Senjata Api Dengan Tujuan Membela Diri”tujuan dilakukannya penelitian ini untuk mengetahui bagaimana ketentuan hukum terhadap kepemilikan senjata api oleh Peraturan Undang-Undang dan bagaimana upaya dalam menanggulangi kepemilikan dan penggunaan senjata api dengan tujuan membela diri oleh warga sipil. Dengan menggunakan metode penelitian yuridis normatif, disimpulkan; Senjata api terbagi dalam 3 (tiga) peruntukan, yaitu untuk bela diri, inventaris dinas dan olahraga, Masyarakat (sipil) dapat memperoleh atau memiliki senjata api secara legal dengan memenuhi syarat-syarat atau prosedur yang telah ditentukan oleh kepolisian, baik syarat berupa keterampilan maupun psikologi. Saat ini, Kepolisian tidak melayani pengajuan izin kepemilikan senjata api pada kalangan masyarakat sipil biasa selain POLSUS, SATPAM, Perusahaan atau korporasi yang membutuhkan pengamanan lebih, dan anggota PERBAKIN karena petunjuk dari Kapolri sampai ada petunjuk lebih lanjut. Dan ada seluruh perbuatan yang dilarang hingga syarat dan ketentuan pidana atau sanksi yang sudah diatur dan ditetapkan didalamnya termasuk ketika jika melakukan penyalahgunaan senjata api dan penyalahgunaan senjata api tanpa izin ada sanksi sesuai pelanggaran atau kejahatan yang telah tercantum sesuai Undang Undang Darurat Nomor 12 tahun 1951. Terkait perlindungan hukum oleh warga sipil terkait kepemilikan dan penggunaan senjata api dengan tujuan membela diri itu juga ada ketentuan hukum dan Peraturan Undang-Undang dan ada saatnya kapan waktunya bela diri. Kata Kunci: Perlindungan Hukum, Senjata Api, Bela diri ABSTRACT Thesis with the title "Legal Protection by Civilians Regarding the Ownership and Use of Firearms with the Purpose of Self-Defense" the purpose of this research is to find out how the legal provisions against the ownership of firearms by the Law and how efforts in tackling the ownership and use of firearms with the aim of self-defense by civilians. By using normative juridical research methods, it is concluded; Firearms are divided into 3 (three) designations, namely for self-defense, official inventory and sports, the public (civilians) can obtain or own firearms legally by fulfilling the conditions or procedures determined by the police, both requirements in the form of skills and psychology. Currently, the Police do not serve the application for firearm ownership permits to ordinary civilians other than POLSUS, SATPAM, companies or corporations that require more security, and PERBAKIN members due to instructions from the Chief of Police until there is further guidance. And there are all prohibited acts up to criminal terms and conditions or sanctions that have been regulated and stipulated in it, including when misusing firearms and misusing firearms without a permit there are sanctions according to violations or crimes that have been listed in accordance with Emergency Law Number 12 of 1951. Regarding legal protection by civilians related to the ownership and use of firearms for the purpose of self-defense, there are also legal provisions and Law Regulations and there are times when it is time for self-defense.
