Abstract

Penelitian hukum ini berjudul “Pertanggungjawaban Pidana Calo Tiket Konser Dalam Tindak Pidana Penipuan”. Permasalahan pada penelitian ini pertama, bagaimana bentuk-bentuk tindak pidana penipuan calo tiket konser dan kedua, bagaimana pertanggungjawaban pidana calo tiket konser yang melakukan tindak pidana penipuan. Penelitian ini bertujuan untuk mengetahui bentuk-bentuk tindak pidana penipuan oleh calo tiket konser dan untuk mengetahui pertanggungjawaban pidana terhadap calo tiket konser yang melakukan tindak pidana penipuan. Metode pendekatan yang digunakan dalam penelitian ini adalah metode penelitian normatif yang dilandaskan pendekatan pendekatan perundang-undangan atau statue approach (juridis-normatif) dan menggunakan metode pendekatan konseptual atau conceptual approach. Analisis penelitian ini berjenis kualitatif. Hasil dari penelitian ini pertama, bentuk-bentuk dari tindak pidana penipuan dalam praktik percaloan oleh calo tiket konser yang dilakukan baik secara konvensional maupun melalui media elektronik atau media sosial melanggar ketentuan menurut KUHP dan UU ITE. Kedua, pertanggungjawaban pidana bagi calo tiket konser yang melakukan tindak pidana penipuan dapat mempertanggungjawabkan pidananya berdasarkan Pasal 378 KUHP, Pasal 492 KUHP yang akan berlaku dan Pasal 28 ayat (1) juncto Pasal 45A ayat (1) UU ITE terhadap penipuan melalui media elektronik. Kata Kunci: Perbuatan Pidana, Pertanggungjawaban Pidana, Calo Tiket Konser, Penipuan This legal research is entitled "Criminal Liability of Concert Ticket Brokers in the Crime of Fraud". The problems in this study are first, what are the forms of criminal acts of fraud by concert ticket brokers and second, how is the criminal liability of concert ticket brokers who commit criminal acts of fraud. This study aims to determine the forms of criminal acts of fraud by concert ticket brokers and to determine the criminal liability of concert ticket brokers who commit criminal acts of fraud. The approach method used in this research is a normative research method based on a statutory approach or statue approach (juridical-normative) and using a conceptual approach method. The analysis of this research is qualitative type. The results of this study are first, the forms of criminal acts of fraud in the practice of brokering by concert ticket brokers carried out both conventionally and through electronic media or social media violate the provisions according to the Criminal Code and the ITE Law. Second, criminal liability for concert ticket brokers who commit criminal acts of fraud can be held criminally responsible based on Article 378 of the Criminal Code, Article 492 of the Criminal Code which will apply and Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of the ITE Law for fraud through electronic media.
