Abstract

Penelitian ini berjudul “ pengaturan hukum banguan objek diduga cagar budaya yang dialih fungsikan di kota Kediri “. Yang dalam penulisan tersebut penulisannya menggunakan metode penelitian yang bersifat normatif, dengan menggunakan pendekatan undang-undang (Statute Approach) dan pendekatan konseptual (conseptual approach) . Denagan ini penulis meneliti terkait dengan bangunan ODCB yang berada dikota Kediri yang beralih fungsi menjadi banguan baru yaitu banguan Mc Donald’s yang bertepat di jalan brawijaya No 21 kota Kediri bangunan tersebut adalah peninggalan dari luitnan der chineze. Keberadaan keluarga ini yang dulunya merupakan kediaman pejabat luitnan der chineze yang telah berusia lebih dari 100 Tahun. Dan menjadi bukti bahwa di kresiden Kediri telah banyak pemukiman orang – orang tiongkok. Rumusan masalah dalam penelitian ini adalah: (1)Bagaimana pengaturan hukum tentang pengalihan fungsi banguna objek diduga cagar budaya sebagai tempat restoran atau resto cepat saji pada banguan leuitenant der chiezen ? (2)Bagaimana perlindungan hukum bagi banguna objek diduga cagar budaya yang dialih fungsikan sebagai restoran atau resto cepat saji ? dari penelitian hukum yang telah disampaikan pengalihan fungsi pada bangunan juga dapat dilakukan apabila dalam penbanguan kembali pada bangunan ODCB memenuhi prosedur atau proses yang memenuhi syarat pada bangunan dan tidak menghilangkan nilai – nilai pada banguanan tersebut. Kata Kunci : Cagar Budaya, Ahli Fungsi, Pelestarian ABSTRACT This research is entitled "Legal regulation of buildings that are considered to be cultural heritage objects that have been repurposed in the city of Kediri". In this writing, the writing uses normative research methods, using a statutory approach and a conceptual approach. With this, the author researched the ODCB building in the city of Kediri which was converted into a new building, namely the Mc Donald's building which is located on Jalan Brawijaya No. 21, Kediri city. This building is a legacy from Luitnan der Chineze. The existence of this family, which was once the residence of a military official, is more than 100 years old. And it is proof that in the Kediri district there are many Chinese settlements. The formulation of the problem in this research is: (1) What are the legal regulations regarding the transfer of the function of a building that is thought to be a cultural heritage site as a restaurant or fast food restaurant in the leuitenant der chiezen building? (2) What is the legal protection for buildings suspected of being cultural heritage objects that are converted into restaurants or fast food restaurants? From the legal research that has been presented, the transfer of function to a building can also be carried out if the rebuilding of an ODCB building fulfills procedures or processes that meet the requirements for the building and does not destroy the values of the building.
