Abstract

Dependents are defined as goods that are used as collateral. Whereas collateral it self means coverage for the loan received. If the debtor defaults, the holder of the first mortgage has the right to selling objects of mortgage rights under one’s own power through public auction and take repayment of the receivables from the sales proceeds. In terms of the creditor is always the party who has a direct relationship of course with the debtor through the agreement they have entered into are ready for all the attitudes of the debtor, but about the auction winner individuals/legal entities who legally and legally carry out buying and selling with the method determined and implemented based on law, winner auction which in this case becomes the buyer of the collateral objek through auctions, even get lawsuits from debtors or other parties because they feel dissatisfied and their rights have been harmed by the decision creditors conduct the auction. OF course, this needs further study so that the auction winners do not become an outlet for the parties dissatisfaction anywhere for the auction of collateral goods given to the party creditor/bank. This research aims to determine the legal basis for implementation auction, as well as knowing how legal protection is obtained by a winner of an auction for land rights if there is a lawsuit from another party feel that their rights have been harmed by the auction of the land rights. Protection the law reffered to here is legal protection that guarantees rights the auction winner for the auction objekct he won. From the results of this research, it is known that there is a form of legal protection obtained by the winner of the auction is, the court decision says that the auction is legally valid and strengthens the auction winner’s rights to the object the auction he won. Meanwhile, if the auction is decided by the court, it will be canceled because law, in this case the legal protection obtained by the auction winner that is, he can demand payment for the auction object that has been deposited with the auction official, and can claim the costs incurred if have registered the auction object.
