Abstract
ABSTRACT In Indonesia, the most frequently performed transplant is corneal transplantation. Apart from hospitals, where transplantation is developing, there are institutions that provide corneas for people who need them, namely the Eye Bank. Corneal transplantation is a procedure in which the cornea of the eye has been damaged and is replaced with the donor's cornea surgically by an ophthalmologist. Basically, the agreement between the patient and the donor occurs because there is a need between the parties, but this agreement does not have a clear legal regulation. The aim of this research is to analyze the legal regulations for doctors who transplant corneas from deceased people based on agreements that have been made. And to find out the form of legal protection for patients who receive corneal transplants but the patient's condition does not improve and tends to worsen. This research method uses a type of normative legal research with a statutory approach and a conceptual approach. The conclusion of this research is that the legal relationship between a patient undergoing a cornea transplant and a doctor is a relationship known as a therapeutic agreement. This legal relationship will be formed due to the fulfillment of the rights and obligations of each party, namely the doctor who carries out the cornea transplant, and the patient who agrees to carry out the cornea transplant. Doctors who perform cornea transplants have responsibilities, namely ethical responsibilities of doctors, and legal responsibilities, namely administrative responsibilities, civil responsibilities and criminal responsibilities.
