Abstract
Total Allowable Catches (TACs) is an instrument established to ensure the fishery resources sustainability. The issues that will be examined in this article are, First, the effectiveness of the TACs regulation to ensure the sustainability of fishery resources in Indonesia. Second, legal remedies that can be taken to ensure the fishery resources sustainability in Indonesia. The research method used is normative research with a statute and conceptual approach. This study found that the determination and application of TACs in Indonesia is not effective to guarantee the sustainability of fishery resources in Indonesia. There are still spesies with over-exploited status in each Fishing Management Area of Indonesia. Indonesia requires new legal remedies such as determining the maximum number of catches by each fisherman and regulations prohibiting fish catches discards back into the sea.
